Let's watch the Kavanaugh hearing.

1. It's about to start. I'll update this post as we go.

2. Dr. Christine Blasey Ford has taken her seat. She's nervously looking around, getting patted on the back. She's wearing a dark blue jacket over a dark blue top and has her hair done in a way that allows it to fall over her face and to need to be pushed back. Senator Grassley begins by apologizing to both Blasey and Kavanaugh for the incivility to which both have been subjected. He says he intends to preserve civility in the hearing and to make it "comfortable" for both witnesses.

3. Grassley criticizes Democrats for sitting on the allegations, allowing them to leak out belatedly, and failing to resolve matters in a bipartisan way. Democrats, he says, are to blame for the pain that "Dr. Ford" has suffered in recent days. He praises himself for doing he could to accommodate her. (I put "Dr. Ford" in quotes to indicate that's what she is being called here. I had switched to calling her "Blasey" after reading in the NYT that she preferred that name. From here on, I'll write "Dr. Ford" without quotes.)

4. Dianne Feinstein: "She wanted it confidential, and I held it confidential, up to a point..."

5. Feinstein casts an aspersion on Grassley: He didn't introduce Dr. Ford. Grassley, angered, interrupts to say that he didn't forget to introduce her. He was going to introduce her at the point when he was inviting her to begin speaking.

6. Still waiting for Feinstein to finish reading her intro statement. Dr. Ford seems to be struggling to keep her composure. After Feinstein, I presume we will hear Dr. Ford read this statement, already released to the press.

7. "I am here today not because I want to be. I am terrified...." she begins, in a creaky voice.

8. Sorry, but I got an hour and a half behind. Will resume.

9. Now, I've watched the entire opening statement by Dr. Ford. She seemed very credible to me. Though she was reading, she seemed to be reliving a real, traumatic experience. It's hard to imagine that she could be infusing her speech with that kind of emotion phonily. Even an excellent actress would have difficulty affecting that kind of emotion.

10.  Rachel Mitchell, the prosecutor brought in to ask questions for the Senators, receives 5 minutes of time from Senator Grassley. Mitchell's use of the time is awkward, because she begin with documents that Ford must read and comment on, and Ford takes her time and makes small corrections to the documents. Grassley interrupts to say his time is up, and shifts the proceedings forward to the next Senator, Dianne Feinstein,

11. Feinstein takes her turn and focuses on the difficulties Ford experienced as her name became known. This material bolsters Ford's credibility, especially to the extent that it seems that Ford knew how painful this exposure would be before she decided to go public. Feinstein's time runs out quickly and Mitchell gets another 5 minutes to continue where she left off.

12. Mitchell's approach enables Ford, just by being careful, to slow everything down. The time will run out. The day will end. Maybe Kavanaugh supporters wanted it to play out like that, but Ford is a credible person, and I think the Republicans chosen approach, including the use of Mitchell, will backfire on them, and Kavanaugh will not be confirmed. I'm saying this at 11:06 ET in my recording, that is, an hour before I'm writing this update.

13. At 11:13 ET, Ford speaks of the "indelible" memory of Kavanaugh and Judge laughing — "having fun at my expense." "I was underneath one of them, while the 2 laughed, 2 friends having a really good time with one another."

14. At 11:56 ET, during the questioning by Senator Whitehouse, I exclaim aloud: "The Democrats are winning by a lot here." Whitehouse is talking about the lack of an investigation.

15. Grassley gets angry and yells — about why there is no new investigation — but it feels so wrong that he's yelling in the presence of Dr. Ford. She's the allegedly traumatized victim — don't yell around her! The Republicans are either too bland — operating through Mitchell — or irksomely angry — through Grassley. Do they know how badly they are losing right now? I wonder how Brett Kavanaugh is doing.

16. I'm skipping ahead, looking to see if Kavanaugh's testimony has begun. It has not. I talk with Meade for a while about what Kavanaugh might say if he were asked if he is 100% certain that Ford is wrong when she says she's 100% certain that Brett Kavanaugh did what she remembers. Here's what I imagined Kavanaugh saying: I cannot be 100% certain. I know that I drank far too much on some occasions when I was an immature teenager, and though I've said that I don't remember ever suffering alcohol-induced amnesia, I cannot know for an absolute certainty that it never happened. Watching Dr. Ford testify has been a horrific experience for me. What if there is a blank, dark spot in my memory where drunken young Brett Kavanaugh did what Dr. Ford describes? I pray to God that's not true, but I cannot say 100% that it's not true, and if it is, I am so terribly sorry. I beg Dr. Ford's forgiveness. I hope for God's forgiveness. I hope that my life's work as a sober adult makes up for what I may have done all those years ago. I still believe I have devoted and useful service to give to my country, and I humbly submit myself to your vote, Senators. And I thank all of you for considering my case, and I want Dr. Ford to know that my heart goes out to her, and my heart goes out to every victim of sexual assault. Thank you.

17. I picture Trump watching the hearings with Ivanka. Somehow I imagine Ivanka reacting like me. I wonder what they are saying to each other. Remember that Trump said at his press conference yesterday that he would watch and judge Dr. Ford for himself, that he had an open mind about it, and he could "believe anything."

18. I've been listening to Kavanaugh for a long time without stopping to write anything. Let me quickly say that I'm finding his opening statement extremely powerful and persuasive.

19. It was a long day! Let me try to wrap up this post. I thought Kavanaugh did really well in his written statement, expressing strong outrage and real emotion. In the questioning, this demeanor sometimes felt too strong. He interrupted and shouted back and seemed to show some hate and contempt for some of the Senators. He said more than once that his family had been "destroyed," and yet his wife is his "rock." The rock is not destroyed.

20. This was the ultimate he said/she said. Both were tremendously strong and they told diametrically opposed stories. If I had to decide, I would not go by who's more likely to be telling the truth, but how everything we've heard weighs on the question whether or not to confirm. In view of everything we know about Kavanaugh, does he deserve confirmation even with the degree of doubt we have about something terrible he might have done when he was 17 (and a couple of other, much weaker allegations)? I suspect most people will end up in the same position they had on him anyway, because it's a matter of weighing. But when I think about how BK and CBF could be so far apart, I have 3 explanations: 1. BK has some alcohol blackout holes in his memory, and what CBF remembers is in one of them, 2. CBF has a false memory and really believes it (caused by some genuine trauma), 3. BK has no route but forward, and he knows he did it, but feels entitled to what he's worked all his life to attain. Since there's no way back to his old life, he must force his way through this obstacle. And he's barreling ahead to save his life and save his family. Cornered, he had to fight like hell, and that includes lying.

And Kavanaugh keeps reminding them that he was 15. A 15 year-old who was working, the captain of his basketball team, a member of the football team, and getting the grades that would someday get him into Yale. Oh; and who kept a personal diary/calendar.

Just one last thing before I'm out the door- Graham's broadside is pretty solid evidence this is over. I know a lot of Republican voters don't like him, but the man is one of the most liked and respected members within his own caucus. I don't think for a second that single member of the Republican caucus will gainsay what he just did here, and I still predict that Kavanaugh gets at least 2 votes from the Democrat caucus.

On how Ford got home after the "party:"

Just speculation here, but I wonder if Ford was at some party, drinking too much (thus hazy about details), left the party, got picked by someone (who knew her just well enough to know where she lived) in a car and sexually assaulted. Might explain much of the sheer confusion over her account and the absence of witnesses.

Doesn't explain everything (such as how she ends up sure it's Kavanaugh), but it explains how she might have so little memory for where and when.

If I were on the committee, I would reassure Kavanaugh with soothing words like bravery and courage and "I believe you." Just like the committee did with Ford. Sheesh, the disparity is nauseating: he has to fight for his life, she gets coddled.

The letter was turned over to the FBI by DiFi - they refused to investigate as there is nothing to investigate - not details, no date, no time, no location. Just somewhere near where I lived in either 1982 or 1983, or maybe 1981 - I don't remember?

There is no reason for one. The supposed "crime" in question does not require federal jurisdiction. Also, the FBI was offered the original letter and passed on an investigation. Also, as Kavanaugh (and Biden) have said, the FBI does not reach conclusions.

So Klobuchar is trying to sell us on the notion that she needs an FBI investigation to be able to have more information, so as to make an informed decision on her duty as a Senator on her "advise and consent" role.

Bull-fucking-shit. Klobuchar was never going to vote for Kavanaugh. She doesn't need more information. It would not make any difference. She doesn't want more information so as to be able to decide between voting Yea or Nay on the nomination. She wants an FBI investigation to delay, to drag things out, and to hopefully troll for some more negative information from the hinterland on Kavanaugh.

NPR just ran it. I think he overplayed it a bit. I agree with him, of course. He raised the right issue; that the Dems just played Dr. Ford's request for anonymity without remorse. I think that the facts are so good (notwithstanding the process being such a riot), that we can dial it back a bit. I hope that during this break our guys get on that page.

This is BULLSHIT, Althouse, and you know it — or to be "100% certain", I assume you know it for the sake of your former students who would be horribly miseducated if they were taught that 100% metaphysical certainty has any non-insane meaning. Not in science. Not in real life. And certainly not in the Law.

I am not 100% certain of anything, including my own existence. I could be a dreaming butterfly or a simulation within a vast computer, but not being absolutely starkers I conduct myself and my interactions on the high probability that I'm real, that Althouse is real, and that Dianne Feinstein is real.

I didn't hear Ford say she was 100% certain of her claims, but if she did it's prima facia evidence she's either a nut and/or a liar. Why should Kavanaugh testify that there's an unknowably small probability he's a serial rapist if Ford did not admit the significantly high probability she is a delusional head case being cynically exploited by evil persons.

To an honest person, evidence-free accusations are indistinguishable from lies.

Blasey Ford didn't know what "exculpate" meant. One NPR talker thought that was cute, and made her seem believably disingenuous, and not like a lawyer. I thought it made her look like a dimwit, the kind of professor who is educated beyond her intelligence and doesn't know what "exculpate" means.

Nobody but a physician, or at least a STEM Phd acting in his professional capacity, should call itself "doctor". And no, psychology doesn't cut it.

I caught O'K's opening statement during my lunch break. He sounds believable and with the corroboration, Doc Mike's therapist recovered mammary theory is sounding creditable.

I havent listened to the questioning, but my guess is there will be a vote.

His disparagement of the senate and his (understandable) lack of emotion control (tears, shouting, anger, aggressively throwing questions back, weird tongue movements, etc) might be his downfall.

The GOP would have been better off with a full FBI rogering to avoid roasting the poor guy on a spit.

An interesting, possibly overlooked question at the end from Orrin Hatch; "When did you learn of the Ramirez allegations?" Kavanaugh's answer was that he heard about it after publication of the New Yorker story.

Which I take to mean that neither Jane Mayer nor Ronan Farrow reached out to Kavanaugh to confirm or deny details of their story. They might have rightly expected that Kavanaugh would refuse them.

But the real point is that they should have asked, and ethics practically required that they ask, but they didn't want to ask because they wanted to spring the story in the way and at the time that suited them.

There is nothing to investigate because all the witnesses claimed by the accusers have contradicted them already. If the FBI had been called in during July, they would have already dropped this case for lack of actual evidence.


Yancey is pretty much right. We're forgetting that Diane Feinstein asked the FBI to look in this matter in her eleventh hour stunt, so they've already declined to look into it. And why would they? Where did it take place? Don't know, not even to the neighborhood. When? Don't know, not even to the year with any certainty. Witnesses? They all say it didn't happen. Is there a chance they can recover forensic evidence? Not after 36 years.

People who call for an investigation have been watching too many Hercule Poirot movies on PBS, where he can figure out everything from nothing.

What in the @#$@#$ is here to investigate? It was (allegedly) 36 years ago. She doesn't know where. She doesn't know when. She's not super sure who all was there, but the 4 people she did name as witnesses all say the party didn't happen, and the 4th, her friend, says she's never me the man (to which Ford replies that the friend is 'cray cray'). The event appears to be an old memory that surfaced when she was defending herself for wanting two front doors.

The FBI might discover that these kids drank in high school (I'm shocked, shocked!).

My PhD program was more difficult to get into than med school. It was a traditional, university-based scientist-practioner program that required original research. I had to create new knowledge using rigorous scientific method. The rejection rate for research medical journals is much lower than that for research psychology journals.. The only thing easier about it was that I was on a full ride because of my academic credentials.

There are plenty of PhDs who are in diploma mills such as Palo Alto University. There are also PsyDs who are a blight on the profession. CBF has a PhD in Educational Psychology. My biased opinion is that those are bullshit degrees. She does appear to know research design and analysis. That is something I did when I was ABD and needed extra money. It's easy.

With all due respect to MDs on this site, PhDs were the original "doctors" when barbers were performing surgery.

Blumenthal was never in Vietnam - check out his wiki page. He was in the MArine Corp Reserve and never saw combat of any type. He also got five deferrals during college before joining hte reserves.

Yes, I thought that was an answer that showed Dr Ford, despite having a baby voice, is not a naif about what she is doing.

That and her hesitance to say who is paying for her attorneys, her playing dumb about fear of flying and the Senators offering to go to California, and the fact that she dated the guy Ed Whelen mentioned, but she wanted to protect him (she could have said it was at his house, but did she not dare to at the last minute?)

My sailing friends and golf friends do not use my title.

I was highly annoyed when the Transpac yacht club listed me as "doctor" on the crew list as "skipper."

Oddly enough, we had a medical emergency on the race, A kid crewing on another boat had concealed his epilepsy, fearing he would not be included. After a week of limited sleep and lots of stress, he had a seizure. There were a couple of doctors in the race and we had a discussion on the morning radio call. We told the other crew members to search his sea bag and they found his anti-convulsant meds. They gave him extra and he was OK to finish the race.

I've sewn up a couple of crew members in other races.

A compulsive/pathological/whatever the proper terminology is for a natural born liar, is more believable than a normal person telling the bare nekkid truth. You just can't go by the impression the person makes in a case like this. You must go by the evidence, and if there is no evidence, use whatever there is and put down your bet.

In this case, there still is no hard evidence, just she said/he said and then that the 4(?) people Blasey Ford has named as being present all say not me, so there really is only 1 she said against 5 he saids.

That, and that what she says happened only amounts to drunk teenagers groping and nothing even close to attempted rape.

This hearing should never have happened.
