In a statement provided by his lawyer, Kozinski apologized, saying that he “had a broad sense of humor and a candid way of speaking to both male and female law clerks alike,” and that “in doing so, I may not have been mindful enough of the special challenges and pressures that women face in the workplace. It grieves me to learn that I caused any of my clerks to feel uncomfortable; this was never my intent"....Sad but true. He could no longer be effective.
Kozinski, 67, said although family and friends had urged him to stay on, “at least long enough to defend myself,” he “cannot be an effective judge and simultaneously fight this battle. Nor would such a battle be good for my beloved federal judiciary. And so I am making the decision to retire, effective immediately"...
There are distinct limits to life tenure.
Political pressure really is a check on power.
It will be interesting to see what Kozinski does with himself now. Presumably, he will take his phenomenal writing and speaking talent and become an important voice in The Reckoning. He's freed from the burden of behaving like a judge at long last. Even as he pushed the limits on how a judge could speak, we can see that the limits were real, and that means that by setting aside the government power he once held, he gets a new power of freer speech, and I want to hear what he says.

Retirement from what?
...and another one bites the dust...and another one bites the dust
If he's retired, he can give honest opinions.
And another vacancy for Trump to fill.
Your hero had feet of clay. I predict he isn’t heard from again.
Live by the dick, die by the dick . . .
Trump gets to nominate a real conservative for the 9th Circuit.
Perhaps, at 67, Kozinski just said to himself "I'm too old for this shit."
A sex pervert, buy hey he is smart. Ah the age of meritocracy.
Now I can say it: Heidi Bond is crazier than Kozinski.
There is a story in the Hollywood Reporter about some weirdo Hollywood git that scalped his girlfriend and let her bleed to death over six hours as he watched. Somehow the writer keeps introducing Trump's name all over the piece, even though it has absolutely nothing to do with him. Kozinski should go to Hollywood now. He's been pre-vetted.
"and I want to hear what he says."
#Metoo
At a guess, he will no longer be listened to even if he does say anything.
There are an awful lot of people yammering all the time. Background noise.
What is the value of speech from the powerless?
Good let him go. His seat will go to another Trump appointee who likely far more amenable to traditional American jurisprudence than Kozinski was. Rebuilding the 9th one judge at a time.
"Political pressure really is a check on power." Lefty women whining really is a check on semi-libertarian power.
Yes, it is crucial to treat women differently from men in the workplace. Most importantly, don't hire them if you have even an inkling that they will make complaints about this or that.
Sad but true. He could no longer be effective. There are distinct limits to life tenure. Political pressure really is a check on power.
Tell that to RBG.
Presumably, he will take his phenomenal writing and speaking talent and become an important voice in The Reckoning.
The most important voice in The Reckoning will be the one that mostly effectively cries BULLSHIT!
Let Trump appoint 3 Conservative Justices. The Left will try to do this attrition. The media will hate him anyway, so why not do this thing?
And that is the peril and problem the Left is having: by continuing having zero tolerance for Trump, they have now made themselves totally irrelevant.
If one can be 'redeemed' or 'worked with' than there would be a reason for flexibility.
With the current C/I attitudes, Trump may as well do as he will because he will never get a smidgeon of love from Chuck, ARM or Inga...so Trump might as well do exactly what he wants.
Should've said he was going to step down 'in the next several weeks'
He's freed from the burden of behaving like a judge at long last.
Indeed. I'm looking forward to that too. But I doubt the media will give him any air time. I guess we'll see
buwaya,
"What is the value of speech from the powerless?"
Jeffrey Snyder had no particular place of power when he wrote his seminal essay, and on a much bigger scale neither did Solzhenitsyn when Gulag was first published.
Sometimes ideas really are powerful.
"Broad sense of humor" doesn't cut it wrt the accusations.
Althouse:
“ He's freed from the burden of behaving like a judge at long last. Even as he pushed the limits on how a judge could speak....”
Not behaving like a Judge is what got Kozinski in trouble with his female law clerks.
This could be a shock to his system. Without the unchecked Federal power to destroy others under him in the Judicial system, and to destroy parties to lawsuits, and to destroy good lawyers, the little creep will find his world that he insults is not full of docile suck ups anymore.
" Political pressure really is a check on power. "
Isn't that a good thing?
"He's freed from the burden of behaving like a judge at long last. Even as he pushed the limits on how a judge could speak,"
@Martha nails it.
Those commenters above who say we can now get a "real conservative" to replace a gubmint librul on the 9th Circuit are revealing their Trumpian ignorance. Kozinski, for decades now, has been the premier pro-liberty jurist. He's been writing about the importance of matters such as property rights and Second Amendment rights (well before the Heller decision) throughout his tenure.
No, the Pussy Hat brigade will not let him speak.
I wonder how effective he will be at making his voice heard, without having extremely smart, capable and bullied indentured servants at his beck and call.
Goodbye and good luck to a seemingly good judge.
Tump'd better get appointing, quickly.
"Sometimes ideas really are powerful."
I used to think so, but I have come to doubt it. In most cases I suspect that these "thinkers" are merely symbols, or personalizations, that other (insignificant) writers latch on to to explain larger phenomena. The memes are expressed, but in fact pre-exist those who gain celebrity from expressing them.
Women love fashion. Out with the old and in with the new. Every change is a "revolution." This explains why last year we were commanded to be astonished by women's tough slutty daring, and this year we've been commanded to weep over their incredible fragility and prissy modesty. This is really no more than changing the height of the hem line on their dresses, with lots of drama.
Next year, women will declare a new, revolutionary and daring course change and we'll all be commanded to swear that this is the absolute truth and what women wanted last year will simply be forgotten.
"I may not have been mindful enough of the special challenges and pressures that women face in the workplace."
Yeah, those bitches have it rough.
When Trump leaves office there will be no one left in the Federalist Society. WINNING!
Good to see you around town ST!
I don't listen to pervs, no matter what their resume says.
