“Koskinen said there was no evidence that Lerner intentionally destroyed the emails. To the contrary, he claimed, the IRS went to great lengths trying to retrieve lost documents on Lerner's computer, even sending it to the agency's forensic lab.”
They did everything except attempt to recover them from the backup before the backup period expired, because that would have been too “costly”.
The emails were evidence in an investigation of which they had been notified.
My legal education has only come from being dragged through the courts for five years by a business partner, but I am pretty sure that that excuse would not have flown with the judge, were I to try to make it.
