She's going after the widow with her Chicago lawyers from Kirkland & Ellis. This should be a hell of a fight.

If anyone had ever supposed that Shirley Sherrod is a shameless, race-hustling parasite, this should disabuse them of that notion. Ms Sherrod is a credit to the Department of Agriculture, that paid her hundreds of thousands of dollars and has rehired her. What do you suppose her current duties entail?

Presumably she's furloughed. I can't imagine she is deemed essential.

My mistake. Apparently, once she had cleared up that she is not a current racist, like me, but just an ex-racist, like Paula Deen, the USDA tried to hire her back. But she declined. So, the current government shutdown is not depriving us of her services.

It's quite understandable that Sherrod, in the circumstances within which she finds herself, would opt for the lawsuit game.

The Widow Breitbart should respond by playing the lawsuit game hardcore, which is what Andrew surely would have done.

She isn't a widow in the eyes of the "progressive" left, she is someone deigned to receive retribution for her husband's actions. This is a message to other's who would expose the ruling machine -- your family is not safe.

Here is the estimable Ms. Sherrod, in March of 2012;

In a statement Thursday, Sherrod said she was surprised to hear of Breitbart’s death: “My prayers go out to Mr. Breitbart’s family as they cope during this very difficult time. I do not intend to make any further comments.”

Note that while most people peay to God, Ms. Sherrod's prayers were directed to the family of the deceased. Apparently, her prayers were not answered, so she is suing. What a fine thing she is.

The clip posted by Breitbart depicted Sherrod as a fair-minded individual. Perhaps it was taken out of context.

For you legal eagles: Is there a chance the administration will pressure Sherrod and her lawyers to walk away because the trial may veer into damaging Pigford stuff?

The administration deep sixed her in a hurry. I suppose they did it because they didn't want anyone looking to closely into Pigford. At any rate, her argument is with the administration who sacked her......OK, there was a story in the Times, but not much follow up after that.

J. Christian Adams at PJ Media says K & E are representing this wealthy and no-doubt talented woman pro bono.

I had previously thought that lawyers had ethics because they cannot afford to have morals. But it appears K & E is motivated by malice, not greed. I am reminded of the Soviet practice of sending an executed man's family a bill for the bullets used to kill him.

He put the video up there. He didn't claim she was racist (his argument was the NAACP was racist for applauding her when she admitted to being a racist). He didn't fire her. He didn't "make" somebody fire her.

The widow should sue her into oblivion.

Jupiter, I think Adams is saying it's unclear what the fee arrangement is with K&E. Plus, pro bono does not mean no fee if there is a large recovery.

I am nowadays a legal pigeon, not an eagle, but there is no way the government is going to pressure K&E to drop the suit. Plus Pigford may be relevant to publicity but The Widow is going to have a hard time making it an issue in the trial.

In my view, a list of links is not the "perfect" comeuppance for the Sherrod lawyers at Kirkland & Ellis.

The "perfect" result would be an order from the trial court dismissing the case and ordering Kirkland & Ellis to pay $2 million to the Breitbart estate, pursuant to Rule 11 of the Federal Rules of Civil Procedure.

Just because I am sort of serious about sanctions against Kirkland & Ellis, I should note that they didn't file the suit in a federal district court. They chose to file in the D.C. Superior Court. Presumably to obtain a favorable jury in a jurisdiction that just might be favorable to an African-American federal worker as the Plaintiff.

And while the Federal Rules of Civil Procedure don't apply in D.C. Superior Court, the actual Superior Court rules are a near-photocopy of the FRCP and yes they have a Rule 11 and it says the same thing as the federal rule.

Lee Stranahan reports her husband and brother are officers in a company which received a $13 million Pigford settlement. Most claimants received ~$50,000.

Poor Shirley.
