"A Colorado school district discriminated against a transgender first grader when it refused to let her use the girl’s bathroom..."

"... the state’s civil rights division has determined, a decision gay and transgender advocates say will have an indelible impact on how such cases are handled in the future."
Telling Coy [Mathis] “that she must disregard her identity while performing one of the most essential human functions constitutes severe and pervasive treatment, and creates an environment that is objectively and subjectively hostile, intimidating or offensive,” Steven Chavez, the division director, wrote in the decision....

It was clear, the state said, that Coy had completely integrated into society as a girl — wearing girls’ clothing, standing in the girls’ line at school and choosing to play with girls.

But the state’s ruling went even further, saying that evolving research on transgender development showed that “compartmentalizing a child as a boy or a girl solely based on their visible anatomy, is a simplistic approach to a difficult and complex issue.”

This is what bugs me: children don't have a clue about what "boys" and "girls" are except by external cues: "girls like pink and dresses and have long hair, boys play sports and roughhouse and have short hair. I like the things girls like; therefore I am a girl."

And instead of saying, "it's OK to play with dolls/want long hair/pretty things even if you're a boy" the new answer is to say, "yeah, you're right, you're a girl."

I agree, though, that there's no reason for boys' lines and girls' lines -- or anything else that unnecessarily splits boys and girls. For small children in daycare, there is no boys and girls split in bathrooms. At my son's daycare, in the 4's room, the stalls were short enough that the adults could see over to know who needed help, and half the time the children didn't close the door anyway.

For younger elementary school children, there's also not a clear reason to worry. But young children turn into older children and teenagers. And for every boy wanting to use the girls' room, isn't there a girl wanting to use the boys' room, urinals and all?

And what do high schools do when a boy claims to be a girl and wants to play sports? Anyone?

I realize that we are all for tolerance and all, but can we not foist sexual hangups on first graders?And if they say they are transgender as a six year old, don't go along with them. Tell them, wait till you're 16 and then we'll have this conversation again.

Also, Im not saying we should hate anyone or hurt anyone, but can we not say that transgender people might need pyschiatric help?Because you're not changing your sex. Youre getting fake penis or vagina added to your body. It's all fake. You're still the same sex.

Also, 19th century homosexual activists in Northern Europe sometimes spoke of themselves as urnings,, that is, women stuck in the bodies of men. How much this involved simply a not-too-scientific attempt at self-understanding versus being men who longed to be physically women I don't know enough about to say. But the language of transgender desire is definitely there.

I read the article and am not persuaded. I'd venture to say that the child was a tool of the gay and lesbian advocates. No first-grader has the cognition to understand gender difference, transgender identity.

Born biologically a boy, Coy began identifying as a girl after just a few years, growing her wispy blond hair long, wearing dresses, and telling family and friends they should refer to her as female.

So apparently Coy began running the family by age 6, telling his/her parents how long s/he was going to grow his/her hair, telling his/her parent when s/he needed to go shopping for dresses, etc.

That, to me, is the aggravating part of this story -- that these parents have abdicated their responsibilities and let Coy have whatever Coy wanted.

also, I don wonder about feminists and transgendered. Because here the feminists have been saying for the longest that gender doesn't matter, and have been trying to remake the world along those lines. And in fact are predicating defense of gay marriage on the idea that men and women are interchangable, and that sex is irrelevant. Anytime someone mentions traditional roles of men and women they get the third degree.
And yet here are some people lumped into the coalition who say sex matters more than anything. So much so that they have to take drastic measures to remake their body so they are the correct sex.
If sex doesn't matter, why would you need to change your sex?

I've read up on these parents. There is a little something wrong with them. All of their children are autistic, except for Coy. Who is now transgendered. Coincidence? Also, the issue wasn't about a first grader using a bathroom stall, the issue was what do we do about it when junior high comes around and there is a locker room to change in? The school wanted Coy to use an either/or bathroom by itself. I think that's a reasonable accommodation. The parents sued. Who's the ones being unreasonable?

This isn't about society peeking into the windows. The parents are demanding that the rest of us go along with their little fucked up world, to acknowledge it and validate it. By putting that boy in the girls bathroom, and by extension the rest of the girls' facilities as he goes through school, the school is sending the message that they agree with what the parents are doing and putting their needs ahead of the objections of any other parents.

Odd thing is . . . (according to a web search) the parents insisted she wear "boy's clothes" until that point when they officially "transitioned" her into a girl. So they pretty much insisted on an either/or: if you like girly things, you have to be a girl. Being a boy who liked girly things wasn't an option.

Yes, I read the article. The child is now six. The article says that years earlier, Coy was growing her hair long and wearing dresses. Show me a three-year-old who chooses his/her own clothing and hairstyles, and I might possibly believe that Coy's gender identity is not influenced by his/her parents.

Mom is a part-time, studio-at-home photographer (http://visionarymom.com/an-interview-with-kathryn-mathis/ -- an older interview, where, when she had to get work done, she turned the tube on for the kids). Big sis, and triplet brother autistic. Triplet sister severely brain-damaged. Probably not getting "boys are bad" signals from mom & dad, but prior to the attention from being "transgender" probably suffered from attention-deficit disorder -- that is, lack of attention by being the "good kid" without needs.

Oh, you'd be surprised how involved this stuff can get. I remember an article in one of the SF Bay Area "alternative" free papers a long time ago (somewhere in the 90s) featuring a MTF transsexual (post-operative) who identified as lesbian. That is, she was biologically male, had been surgically altered so as to appear female, and was attracted only to women.

Today I caught on the teevee while passing, didn't linger because it was annoying, the Colorado government station, a young woman was bragging about all the social projects that Denver Public Schools is becoming known for. At the moment I passed through she was remarking that visitors from other states are coming here, studying Denver's success, using Denver and Colorado as model for their own programs. I did linger but only momentarily, the vocabulary drove me off, fairness, justice, awareness, access, she was talking about social things so her subject was tangentially political and I was reminded the whole Colorado ballot was populated with people who came up through the Denver public school system. The Democrats in Denver have transformed DPS, parlayed it into political machinery that produces Democrat candidates for various offices, all offices, and that is all that is available on the ballot with a few exceptions. It is actually not so easy to research either because they're claiming to have non-party ballots while laughing privately because they're ALL Democrats. And we end up with schoolmarm legislators that pass legislation overly liberal for the rest of the state and truly believe they are fighting the good fight. You know the rest. Sheriffs protesting, recalls started, but all that is the price to be paid for progress whether or not we troglodytes want any such thing as gun control.

Proud of everything but teaching in the portion that I heard. And because of that, because Party is using state resources for Party, now that it's ruined, I must vote against k-12 education here every chance that I have, to strangle it, until that is corrected, probably never.

There are more girls than boys. The girls are smarter and less geeky. They have been accepted at more prestigious schools, such as MIT and Carnegie-Melon. And finally, the girls have better social skills.

The earliest memory I have of my younger brother is when he was three years old and he borrowed a blue dress with a white collar from our sister and went out to play with the other kids. Within a few minutes he came back inside crying.

This was 1959 and my parents had nothing to do with it. He grew up seemingly straight, a cool surfer kid. He got mixed up in drugs and was dead before he left his teens, his sexuality unclear.

Human beings are very complicated. Their sexuality too. I think it's possible that a child could identity with the other gender. I think it's possible that a child could go through a phase like that. And I think it's possible that a child could respond to some weird parental programming on that score.

But almost all of us, I suspect, have insides that don't entirely match the outside roles we have in society. There are limits to how much society should shape itself to accommodate all the millions of psychological configurations people come in.

Gene, Is it really surprising that more girls than guys would show up at a potluck party, be less geeky, and show better social skills. That's like saying they are more girl-like than the boys. Hasn't this always been true?

This reminds me of the Who Song I'm A Boy, but in reverse. In that song the mother dresses the boy up like a girl because she wants a girl, but he just wants to do boys stuff> He's a boy he's boy but his mom wont admint,and if he says he is he gets it.
The who wrote it as a dystopian future type song. The song was supposed to be part of a musical that he intended to write, where parents of the future were allowed to choose the sex of their children. The singer's mother has selected four girls, and by mistake, three girls and one boy were born instead.So she dresses him up like a girl.

The future is now. Only now a six year old with no context of the real world, or even an inkling of what sex is about is telling their parents what they are sexually.
Kids say they are alot of things. Parents should be parents and put their foot down on this kids need to change his sex. If, when he's 18 he still wants to do it, god help him. But at 6? that's crazy.

The civil rights folks in CO are out of their mind. My sister had a phase similar to this when young where she did the whole boys' haircut thing and insisted people call her a boy. And then it passed and she went back to being a girl long before puberty hit.

The point is, children have more of a fluid sense of identity than adults do. How many boys have thought they were Superman or some other super hero at some point, or an animal or cartoon? The adults are supposed to know better and while the behavior might be indulged, they're at least expected to know better than to take it all seriously at that age.

Side question - if Coy at some point later decides to identify as male, does he still have the "right" to use the girls' facilities, or is that a right that depends on what gender he or his parents think he is at any given point in time?

Going to the bathroom should not be a "sexualized" activity. A person should go the bathroom that best accommodates the biological plumbing that they have. If you have a penis, you should use the male bathroom. There's a practical reason why it's different from the female bathroom.

I've read up on these parents. There is a little something wrong with them. All of their children are autistic, except for Coy. Who is now transgendered. Coincidence? Also, the issue wasn't about a first grader using a bathroom stall, the issue was what do we do about it when junior high comes around and there is a locker room to change in? The school wanted Coy to use an either/or bathroom by itself. I think that's a reasonable accommodation. The parents sued. Who's the ones being unreasonable?

Everything looks easy if you haven't had to deal with it.

There's a guy at work who had twins. At age four one of them decided he was a girl. My coworker and his wife tried for months to change his mind. They did everything you could possibly think of doing, including getting professional help.

What they learned is there's a limit to what you can do as a parent. This is a physiological problem - it has nothing to do with what they fed him or how they treated him or breastfeeding or any of the other things people normally assume to be causative.

I get there are some parents who screw up their kids in an effort to prove something about gender politics. But that's not the normal case - nobody outside academia wants to try to explain this kind of thing to friends and relatives. In my coworker's case his mother-in-law has severed ties with the family after accusing them of doing... something to mess up their son (but not his twin brother).

At the advice of counselors they put their son in a different school and allow him to dress as a girl. He uses the girl's restroom. Apparently there's some percentage of kids for which it ends up being a phase, but that's not usually what happens.
