He was trying a classic failed method to get back in the chair. It's almost impossible to do it by swinging your legs up like that. First you have to pull up and get your armpit to support your weight, raising your center of gravity. Then you can be more successful swinging your legs up.

We see this in the Marines a lot. Some people take a lot of convincing to learn the correct method.

Oh, you can be assured there will be a lawsuit. After all, why should anyone be accountable for their own actions? He screwed up and someone must pay!

Several years ago in Colorado Springs, a young teenaged boy climbed over the security fence at an electric substation. He survived an encounter with an electric transformer (several thousand volts). Naturally, the parents sued the city owned utility company for millions of dollars. Just because their son is an idiot, that's no reason why he should suffer the consequences of his actions.
