It's not as bulky as a hawk and its tail when roosting is narrower than a hawks. A coopers hawk has more grey and is mottled on the breast this bird is tawny like a Perigine or a sparrow hawk. Size is hard to tell by the picture.

My daughter and I rescued a crow in our yard last Saturday, and brought it to a wildlife rescue place off Rimrock. It did a near perfect "play dead" impersonation when I went over and picked it up, complete with a total neck sagging act.

We called the rescue center back a day later to check up on it, and they said it had a broken leg. Not sure why it wouldn't/couldn't fly away. I asked them if I could pick it up, as I was thinking about making a pet out of it. They said no dice.

If this photo was all I had to go on I would list this bird as a hawk in the bird-hunting genus Accipiter -- either an adult Cooper's or Sharp-shinned Hawk.

Both are slight in comparison to their more bruising, rodent-wrestling cousins in genus Buteo (e.g. the common Red-tailed and Red-shouldered Hawks of North America).

Among falcons, only a female Kestrel or male Merlin could display the russet I'm seeing on the breast or this raptor. But facial markings would be obvious on a Kestrel (aka Sparrow Hawk)in this posture. I'd eliminate Merlin (aka Pigeon Hawk) based a lack of dark breast streaking over the russet background, and on the pure white vent and undertail coverts. A Merlin of the Northern Great Plains might show pure white there, but would also be a much paler bird overall.

Finally, there's a general impression of head shape and bill length that is un-falconlike.
