The Blutarsky/Feingold Philosophy.

"It's not over until we say it's over." That's the political theory. Meanwhile....
Unions representing public workers in Wisconsin filed a lawsuit in federal court on Wednesday to block the state's new curbs on collective bargaining... [claiming] the controversial measure is unconstitutional because it creates two classes of public workers in the state -- those covered by the new rules and those exempt from them.
What? Treating police differently from teachers is supposed to be an invidious discrimination under the Equal Protection Clause?! There's no suspect or quasi-suspect classification, so the courts will give this minimal scrutiny. How is this anything but a frivolous lawsuit?

Blutarsky/Feingold marches on.

NOTE: The "Animal House" epilogue tells us what ultimately happens to each character, and the biggest joke is that Blutarsky becomes a U.S. Senator! (Thanks to Bruce Hayden, in the comments, for reminding me of that.)

The case seems to offer a good opportunity for the courts to refudiate their degree of scrutiny nonsense when it comes to civil rights violations.

There should be only one degree of scrutiny: All laws infringing on civil rights should be overturned unless they serve a "compelling state interest."

In the actual case, however, the court would then logically find that compelling union dues is illegal since it violates the rights of unwilling workers with no compelling state interest in forcing unions on everyone.

Of course, Teddy's seat flew out under great fanfare. Did you see his Catholic funeral? Stinker didn't deserve that, either.

How odd, also, the scorn that is heaped by (presumably) working people on other working people who are simply trying to protect their stake in "the American Dream," (that is, jobs with decent wages and benefits) by striving to protect their rights to collectively bargain for their own working conditions. This is the essence of participatory democracy in action!

Agree or disagree with their aims, (I agree with them, as if that needed to be said), all Americans should applaud their right to take action and their interest and vigor in doing so.

This is where you have to see that Sarah Palin made a good decision for the state of Alaska and it's citizens by removing herself.

She saw the endlessness of the lefts desire to use the system and cost the state money, time and the attention to governance...and did the egoless thing by opting out. While it seemed like a win...they drove her out...she was able to see that the real win at that point was stopping the grinding down of the state's governance life.

All of those suits were directed at her personally, very different than at legislation here in Wisconsin. Repubs need to just stay focused and keep rolling along, remain commited themselves to rule of law, follow the rules, don't get cute and the people will stay with them.

BUT free speech surely does not include a right to force others to listen to you.

And that, too, is democracy in action. For, who should determine what behavior is acceptable for on-duty government employees- their union, or the People, through their elected representatives? Who should determine what level of staffing is appropriate- those who pay for it, or those who provide it?

This is not the citizens seeking redress of grievances from the gov't. This is the government negotiating with itself to determine how much they're going to take from the citizens. Or to put in terms of the employee/employer relationship -- here we have employees negotiating with other employees to decide how much they're going to take from the employer, with the employer never getting a say.

Oh, we do get a say at the ballot box, but the employees have determined to ignore the ballot box and keep on doing what they want to do.

According to Wisconsin statute 12.13(3)(a), no person may file a declaration of candidacy "knowing any part is falsely made." If a candidate claims to support a party he or she does not actually support, that candidate is in violation of 12.13(3)(a).

It is a Class I felony.

The outcome of the various fights for workers' rights around the country will foretell the treatment all American workers can expect in future. As it is, we're rapidly becoming a nation of unemployed or underemployed serfs to the financial elites. Rather than scorning those who have good pay or benefits and who are fighting to keep them (or the right to continue negotiating for themselves), we should all be demanding the same rights and have the same expectations for ourselves.

The problem is conceptual. Reasonable people see each political event as a self contained mattter in which a conclusion is reached and life goes on. Such people look to live in peace and make positive assumptions about the good will and good sportsmanship of those that oppose them. They see opposition as being linked to an issue and therefore temporary rather than to a condition that will never change. The lesson is that after every victory such as the recent one in Wisconsin every method conceivable must be employed to keep these folks on the run. No rest, no quarter, no compromise. I'm wondering what all this tells us about school boards and county boards who quickly rushed through new contract extensions. An acquaintance of mine is the president of the local school district's para-educator union. After they spent a solid weekend or two re-negotiating a contract, her comment was "Our board came through for us." What? I thought the school board was there to represent the taxpayer, not the unions. But then in this district, the unions had campaigned heavily in the previous election to get a board favorable to the unions.

School administrator don't want to fight the unions, so they give in on things such as seniority and evaluations.

They will never stop doing this. They will disregard the will of the people, legal precedent, the Constitution, and all bounds of reason, propriety, and decency to get their way on this. Because if they don't, half of the money flowing into the coffers of the Democratic Party will vanish.

This is also why they will go to the mat against tort reform forever, no matter how many blameless doctors or corporations are victimized by the scum-sucking pirates of the plaintiff's bar. Take away the government employee unions and the lawyers, and the Democrats will be bankrupt tomorrow.

BTW, Trooper, I need to thank you for the term "douchenozzle". I always used the term "douchebag", but "douchenozzle", the part that actually goes up the hoohoo, fits J to a tee. In fact, I've worked it into my vocabulary to the point that I have other people using the term over the C.B.

In fact, I used it just the other day. Some douchenozzle was stupid enough to call a female laborer on the jobsite a "bitch" over the C.B. After I tagged him as a douchenozzle over the C.B., 6 other guys followed suit.

There's been more than one time I've stuck up for women on the jobsite. Homey don't play that. I don't care if you're black, Hispanic, or you have tits. I love working with people who are brutally competent. I care not of what variety.

Don't forget that the Justice Department denied a community in North Carolina when they asked to have nonpartisan community elections. The reason was that 'African-Americans wouldn't know who to vote for if they weren't identified by party'. So, no, I don't think they can identify a "fake Democrat". Public schools are a monopoly. As such, they should be treated like other regulated monopolies such as the local phone companies and electric utilities. The latter have a Public Utilities Commission that sets their rates. School monopolies should be subject to PUCs as well, and would not be able to increase their funds unless they can justify the rate increase.
