Legal realism: there's also voter realism, where they realize that they had no voice in a matter they disagree with.

So there's feedback into legal realism via the judge not getting onto the Supreme Court.

Checks and balances.

Ambitious judges might want to avoid such decisions.

D'oh! academics, not acaddemics.

Of course, spelling is an attempt to map the manifold experiences of the human ear into a cold line of text. It's obviously impossible to do this correctly. Can a judge with a Southern accent possibly spell the same way as a Northerner? Could a Brit? One only has to look at Shakespeare to see that spellings have changed over time, and even strict conspelligist Antonin Scalia has made the occasional typo.

Legal realism to me means realistic expectations as to a judges rulings. After Blackstone and others started the habit of "reporting" prior decisions from a judge to help in the lawyer's real world work (to win ), then a casebook of studying Precedent Decisions on like facts became possible for lawyer tranees who were "reading the Law". Judges then claimed that they had great respect for prior decisions, as a way to escape the heat, and began calling that Stare Decisis, in Latin to look noble. That's the reality. Appointing the Judges is the greatest everyday power inside the kingdom.

Glen Reynolds is not just Too Southern, he is from the Knoxville/East Tennessee area. That area still suffers from an over-mountain inbred culture that resists becoming over-educated, like finishing High School.

A carnival or two.

"Heh" link with nothing else.

One or two photos of protest babes.

A few bacon stories. A carnival of bacon will let you kill two birds with one stone. A protest babe covered in bacon would work just as well.

The comments are moderated? Really? I'm not moderating them. I do note that they aren't very numerous.

I had to moderate the comments, and I approved everything except a few unintended repetitions and a couple that linked spammily. Nothing was deleted for viewpoint or bad language or anything that at all raises a free speech issue.
