I'm watching the second panel at the conference now. My panel -- about law review writing -- is over, but you can read about it over here on Larry Solum's blog. The second panel are all people who write about law for the popular reader: Dahlia Lithwick (of Slate), Adam Cohen (NYT), Jamie Heller (WSJ), and Richard Sweren ("Law and Order").

Re Randy Barnett, this seems as good an opportunity as ever to exhort all readers here to go and read his excellent book Restoring the Lost Constitution, and having done so, you should then read Steve Calabresi's excellent explanation of why Randy's totally wrong about individual rights, S. Calabresi, The originalist and normative case against judicial activism: a reply to Professor Randy Barnett, 103 Mich. L. Rev. 1081 (2005).
I have a great deal of respect for Randy's scholarship, which is to a fault very well written and researched, and often very persuasive. But to be honest, I admit that I've lost a little bit of respect for him after his spat with Scalia -- although to be fair, the odds were against him: I can count on one hand the people who I would bet had a better than even chance of persuading me that they were right rather than Scalia in the event of a dispute, and two of them are dead!
Is it just me, or does it seem like Dahlia Lithwick has really short arms?
Were there any discussions on the ongoing practice of replacing (competent) US Attorneys with political appointees that don't have to face the Senate for approval?

I always thought Lithwick was in her late 20s or so. She is obviously well over 40 and not much younger than Althouse. It just suprised me. She must have had a career before law school.

That demi-scallop plunging neckline reduces the severity of the style and colour, and makes you look sleek.

Uh. What happened to the first picture?
Tiggeril is referring to some weird hack of my Flickr page that was causing the picture to be something else -- a swimming pool for no apparent reason. Can anyone explain that? I figured out a work-around, but I don't know why it happened.
Wasn't a swimming pool here - it showed up beifly as a couple of cats lying around on someone's floor. I was about to email you about it, but it seems to be fixed now.

Why is it that when anyone else makes a negative comment about Althouse, hordes of her lovely and loyal commenters instantly come to her defense, but when Maxine Weiss floats in at random to take a shot, no one says a word?
