I'm reading "Cornell Police Report Omitted Student’s Claim She Was Raped/Documents obtained by The New York Times show that the campus police at Cornell University sent a condensed statement to a prosecutor, who then declined to bring charges" in the NYT.
The woman spoke for hours with [a campus police department] officer;... The officer then condensed the interview into a six-page “voluntary statement” written from her perspective.... The student, after leaving about 20 handwritten corrections on a draft, signed a final version the next day. While the shorter statement explained that she felt some of that night’s events were a crime, it omitted some of the more forceful and definitive language she used. And it was missing her unequivocal statement that she had been raped....

More detail — better detail —  in today's episode of the NYT podcast "The Daily": "The Firestorm Over a Rape Allegation at Cornell." I wish I had a transcript so I could quote some things.

This is a complex story, and the news media seem to want us to look into it right now, for whatever reasons. The news media and key political actors: New York Governor Kathy Hochul appointed the state attorney general, Letitia James, as a special prosecutor in this case. There's a press conference going on right now:

Hochul said she was concerned to learn what information was taken from Jane Doe’s interview with police and passed to the district attorney. “In what world would the police learn from the victim that she had been literally been gang raped” and that she believed “100 percent” she had been raped and not elevate those allegations to the district attorney, Ms. Hochul asked.

As Althouse hints, this seems to be more about making this an issue now than careful consideration of the facts of the case. This Jane Doe, by her own testimony, seemed to go to the frat house looking for sex, agreed to sex with multiple partners, and at some point felt that it had gone too far, yet failed either due to lack of sobriety or other factors to tell her partners to stop. That’s a hard case to prosecute, because the victim isn’t making clear the line. If you think there was room for doubt in Lindsey Clancy’s case, then you must see the doubt here (or biased beyond reason). I say this as a former juror in a sexual assault case.

Beyond this being a news item, I don’t really care about the case. I don’t see an injustice here worthy of national news. I didn’t care about the Clancy trial except for how poorly it was being reported and wondering why. Which makes me wonder something about this case. Was it a particular guy that the victim didn’t want to have sex that somehow participated, and she has some reason for not calling out exactly who?

But I do have strong opinions on the plaintiff's attorneys, who served an innocent person with papers accusing them of being a rapist, and opened the door to internet vigilante mobs harassing them.

And I also have a strong opinion on the decision to sue Cornell, because they have deep pockets, not because Cornell actually committed a tort or wrong. That was greedy as shit. And evil.

Based on now released texts between the "victim" and one of the "rapists" the girl was proud of her sexual adventure, and only regretted it when the president of the frat un-invited her to their halloween party. She also texted with the guy who seemed to be in charge of the gang bang, complaining that his bragging about it would ruin her reputation- then agreeing with him it would all blow over in a few days. It wasn't until her roommate told her to call it rape she did so- hence the differing statements on different dates. Not sure if the plaintiff really expects this case to go to trial, esp to a jury. This might be the case where kicking men off the jury ends up in a mistrial.

But something, else might be interesting. Plaintiff apparently voluntarily consumed alcohol and ketamine, and consented to multi-party sex. Vitamin,K (ketamine) is, among other things, is a (mild) psychedelic. How reliable would her testimony be, after voluntarily taking a psychedelic? What did she consent to? She can’t be sure. She doesn’t know how many partners she had that night. Which suggests that she didn’t know who her sexual partners were, or really, which ones she gave consent to. This is probably part of why the DA essentially laughed when asked about filing charges.

Someone I know who knows someone who's daughter was hoping to go to Cornell (but who has maybe marginal academics) was overheard doing an oral text to another person I know - "Sounds like [ms x's" chances of getting into Cornell just went up." I laughed out loud for about 30 seconds. That is about the only funny thing in all this. Feel kind of sad for the young woman. Because fraternities still, to this day, put on the best parties. Period. Was the same way 50+’years ago. Same today. Sororities are where the pre-party drinking goes on, on Friday afternoons. Jane Doe was apparently drunk when she showed up at the fraternity party. Very typical of a lot of co-eds. Drink all afternoon with the women, then go to the real parties, with guys, very well lit.

Why don’t the girls put on really good parties? Because sororities very often suppress much of the sex. Fraternities often don’t. Daughter, a bit over a decade ago, belonged to a sorority, at a small liberal arts school in the vicinity of.Cornell (and did her 2nd physics REU. (Research Experience for Undergraduates) working with a particle accelerator at Cornel). They had something called Sober Sisters, where every two possibly drunk sisters went out with one sister who had pledged to stay sober that night (duty rotated). And their biggest job was trying to prevent the non-sober sisters from going off to guys, rooms with them. And there were nights when that wasn’t sufficient. The non-sober sisters often just wanted to get laid by a guy too badly. The sorority house had a zero tolerance hookup policy. Hence why the serious drinking was saved for when guys were there.
