I don't think this is really as bad as everyone is saying. Prosecutors often come to a set of facts with the initial belief that a crime has been committed and X was the perpetrator. It may not be best practice in terms of getting a credible investigative result, and it would be nice if prosecutors had a bit more humility, but structurally, the prosecutors's office (like the rest of the executive branch) is not a neutral or impartial participant in the process. They're just there to put people in jail (unless it's Philadelphia, I guess).
In the US, we have structural roadblocks to restrain prosecutors' expected bias against possibly innocent parties: grand juries, petit juries, and judges. Where this breaks down is "the process is the punishment," where prosecutors have enormous discretion to harass the targets of investigation before they hit any of these checkpoints. But that's an inherent problem with the discretion given to prosecutors, and the lack of outside oversight over their decisionmaking (and what outside oversight exists is usually just hacks looking at crude race metrics and complaining they indict too many non-Asian minorities). You can't really paper over that problem by asking prosecutors to *pretend* to be neutral in their public statements. And that's all it would be -- a pretense. I don't think anyone *really* thinks a special prosecutor appointed by the governor would be objective in this case. The whole point of looking again is exactly that political actors think the wrong result was reached the first time.

Based on the girl's own texts and sworn statements contemporoneous to the events in question, no ethical prosecutor would bring this case to court or even a grand jury. The only rational conclusion here is that, at best, you bankrupt the defendants in defending themselves against this case for which the not guilty verdict should be a slam dunk decision- or you actually get a jury to convict them with no evidence actually supporting a guilty verdict (which is what I expect will happen given the jurisdiction).
I expect a lot of extortion will be used to get one of the defendants to turn state's evidence and, given it is Letitia James, I expect that extortion to be unethical, too.

MeToo is back. In Canada, allegations against Professor Steven Galloway started to get widespread attention in 2015 over actions that took place in 2010-11. He was about 35 in those earlier years, and had a long extra-marital relationship with a woman of about his age, i.e. not a kid. That somehow ended with hurt feelings. He liked to go out drinking with students. The words "assault" and "rape" started to get attached to the one original charge, with the sense that the University might do nothing about it. After years of Galloway suing various people to try to get his reputation back, Chelsea Rooney (about 5 years younger than Galloway) has settled her part of the lawsuit, which is finally supposed to go to trial this month. He's probably in the neighborhood of 50, Rooney in the neighborhood of 45. She has seen the light. She never questioned the word of the one original accuser, she did everything possible to broadcast all charges, and encourage women to come forward with any and every charge they could think of. She did everything she could to ensure any due process was violated in a way to hurt the professor, whom she now admits helped her career, asking nothing in return. An investigator in 2018 found no criminal activity, but something like poor judgment in a love affair. The U fired him, 8 years ago.

This is so wrongheaded. Prosecutors are of course supposed to be neutral and evenhanded in terms of investigating crimes and making charging decisions; and their job is not just to put people in jail: it's to sort out who's guilty and who's innocent and only put the guilty people in jail.
And what James did this is every bit as bad as it looks, not necessarily because she came into the case with a preconceived notion that the named individuals had probably committed rape, but because she PUBLICLY BRANDED them as guilty without giving them any due process, and before she conducted any investigation. The fact of her PUBLICLY condemning these men creates a conflict of interest, because now she has a personal interest in seeing that they are in fact found guilty. If she fails to achieve that result, she will likely suffer huge personal and career embarrassment and possibly have to face defamation claims and/or disciplinary charges.
If you think what she's done here is normal and expected behavior for a prosecutor, you're either being extremely obtuse or you have a very dangerous view of what our justice system should look like.
Like I said yesterday, Letitia James shouldn't have become the special prosecutor -- unless "special" means "especially biased."

Like, sure, that would be nice, but I worked on white collar defense cases for 20 years. I remember a senior ex-prosecutor almost hacked up a lung scoffing when I, as a young associate, suggested that the prosecutor might be open to considering contrary evidence. You need strong evidence that their theory is actually *wrong* to derail an energetic prosecutor who is convinced your client must have done *something* wrong.

Balfegor, any prosecutor who does not welcome any relevant evidence brought to their attention, particularly before a filing decision is made, is a fool and, as far as I am concerned, unethical.
I would not have worked in a prosecutor's office who would not. The goal is to do justice, and that includes only filing a case where there is a strong basis to believe that it can be proven beyond a reasonable doubt.

That’s why the appointment of Letitia James matters. If she believes charges are warranted, she’s unlikely to back away simply because the case is difficult or unpopular. She appears willing to take an aggressive case to trial.
The jury is another matter. A woman can consent to sexual activity with one person, several people, or certain acts and then withdraw that consent or refuse further activity. She has every right to do so.
The challenge is finding a prosecutor willing to make that case forcefully to a jury despite the social attitudes surrounding rape. James appears willing to take that risk.

And by Hochul reassuring other real estate developers in New York that the law will never be applied to them, she also plainly admitted that it was a political prosecution aimed at one man.

Have you ever worked on a college campus as something other other than academic or administrator? I have. The biggest problem with student behavior on campus is- the campus isn't part of the local community. Oh, it's within the community, even within the political bounds. But- any major and most minor colleges have their own 𝑶𝑭𝑭𝑰𝑪𝑨𝑳 police department. As in- they aren't actual police, they are full on police, and employees of the college, not the town, country, or state. And they answer to- the school's administration.
They don't arrest or even ticket or even take note of anyone 20 years and 364 days and under with alcohol in their possession. If they enforced that, well, they'd be out of a job and a more compliant police force would be hired. Can't be harassing the customers now, can we?

Well, well, they're considered on- campus housing. Doesn't actually address their physical location, but let's assume they are under control of the university. That means- to my mind, since the laws concerning alcohol and drug use are being looked at with a blind eye by administrators AND OFFICIAL POLICE, they are enablers of the abuse that took place- and should be held financially responsible for any financial awards that result from cases that involve drug and alcohol use on campus. And the often unsettling behavior that comes about from their overuse.
You can't say "these are on campus and we enforce what laws we want to here" and on the other hand say "and we're not responsible for any illicit activity that occurs and other results coming from that illicit activity that we refuse to police."
Having a policy that says- "Don't use drugs or drink underage" and then refusing to police those policies is the same as not having any such policies.
I used to walk the dorm hallways for fire and safety reasons and heat calls. And you could see smoke coming out from under the doors into the hall that obviously wasn't tobacco. And each morning there'd be boxes in the halls filled with discarded empties of enormous quantities of alcohol- where the average age of building occupants was <21. Police- official police with full police powers - wandered those same halls. Ignoring all of that.
Also will add- if you're allowing people to sniff ketamine off your naked body- you're not a sweet young naive innocent female. Join the big leagues and get paid for it. Hang out with pro-football players. They seem to be mostly ignored unless their drug use results in violence. And they spend heavily on their female acquaintances.

This whole saga is turning into a contest to see who can be the most irresponsible. For the moment Hochul is in the lead.
Gospace, I can remember back in the sixties and early seventies reading* about those campus police. In those days, in some cases at least, they were tough, law-and-order types. It wouldn't surprise me if the student radicals at the time demanded that the campus police be de-fanged, and wimp college administrators went along with it.
*There was a book with a name something like "Radicals' Guide to Colleges" that was a take-off on the conventional guides, giving such "statistics" as "hips-to-squares" ratios, and rating how tough the campus cops were.
