Why is he allowed to take the Fifth on questions covered by his pardon? Can't he be compelled to answer? There's a tool used in California to force testimony in these situations. It's called use immunity. The prosecutor essentially agrees not to prosecute unless he can prove guilt without using the testimony. It's a high standard. But it allows perjury prosecutions.

By pleading the Fifth, Fauci is de facto rejecting Biden's pardon. The ability to reject a pardon was acknowledged by the Supreme Court in the 1833 case of United States v. Wilson. Further the Supreme Court in Burdick v. United States confirmed that a pardon may be refused, and found that a refusal to answer questions by pleasing the Fifth Amendment following the issuance of the pardon.

I read the WP article. Not surprisingly, it's about as positive a write up for Fauci as you can imagine. What would you expect? The Washington Post was part of it.......I don't think threatening to jail Fauci is the percentage play. He's eighty five years old, The optics would be terrible. Fauci can just as well play Galileo as any other scientist. He'd probably be convincing in the role. Instead, announce in advance that there will be no criminal prosecution for his answers and then ask the questions that need a straight answer. I don’t know the legal consequences for Fauci. I have my doubts justice will be served at all. However, I know thousands that lost their jobs and thousands more that lost their loved ones and all of us lived a “new normal” for two years that shouldn’t have been. Dr. Fauci is the embodiment of the reasons for those losses, because he initially defied Congress by continuing gain of function research and then lied about the release of a new virus created from the research. The vast majority of people watching this will not find sympathy for Fauci nor for anyone defending him from consequences.

Note that in most situations a witness cannot selectively choose which questions to answer and which to assert the fifth for. If you answer a question regarding any aspect of the subject matter, you waive your fifth amendment rights.

The 5th Amendment is not a privilege, it's a restriction on the government, all of the first ten amendments are.

You cannot hold someone in contempt for legitimately asserting Fifth Amendment rights. It is a Constitutional right. Constitutional rights are the bedrock of our nation, and they apply even to contemptible weasels like Fauci. If Fauci hadn't shown up he could be charged with contempt. But he has every right to say that he can't answer that question because it would mean that he would be admitting something that could incriminate him.

If you want to make Fauci pay, here is what to do:
Sue him in multiple states alleging he, Daszak, and Baric created COVID-19 and directly caused the deaths of loved ones. This will get Fauci etal. to answer questions or directly suffer financial pain by continuing to invoke the 5th amendment. As far as I can see, this is the only way to make Fauci pay for his crimes and lies.

1) Fauci's crimes go back to COVID's origin and gain of function research which he illegally helped fund, and then lied about.
2) The "vaccine" never worked as advertised by Fauci and other talking heads. It didn't stop the spread, and it didn't prevent anyone from getting COVID. And it's dangerous side effects were hidden. Especially for young people.
3) Life saving treatments were vilified and stopped in order to promote the mRNA experiment being done on the public at large.
4) Rollout and enforcement of the mRNA violated the basic tenants of the Nuremberg Code. Fauci led that effort.
Fauci is they lying pointman and the creator of all this. He is not just being scapegoated. Those of us (including Rand Paul and Elon Musk) who know Fauci is a criminal, are on the exact right side of this.

That applies only in a criminal prosecution; the opposite is true in other contexts. In civil litigation in most states judges will instruct juries that they may draw an "adverse inference" against a witness who asserts the Fifth.
States can charge Fauci just like the can charge ICE agents. If they have a defense that they were doing their jobs they can remove any state criminal charges to federal court and the case will be tried there.

I sympathize. But as a practical matter, by the time that gets to trial Fauci will be in Biden-Land and not giving a fuck one way or the other (he’s 85 now). Give him whatever pardons/immunities are necessary to take the Fifth off the table. Then he’ll have to either tell the truth (win!), lie (and go directly to jail-another win!) or resort to the Steve Martin defense (I forgot!). In any case the Covid-19 issue will be resolved beyond a reasonable doubt and not evolve into a mythology with Fauci as a martyr.
Fauci is not a scapegoat, which is defined as one that is made to bear the blame of others. He is being blamed for his own crimes, although many rats followed the pied piper. Nothing being done to Fauci is unfair, except that he is escaping judgment for terrible crimes that everyone knows he did. There is no question that he illegally funded the research that created the virus, and that he repeatedly lied to the public, and that he lied under oath. He is escaping justice because our election system is one of the least secure in the world. The background here is interesting. Fauci was an important player in the federal policy controversy concerning the treatment of AIDS. He headed an effort to discover an AIDS vaccine and had no interest in treatment therapies, which are what have allowed AIDS victims to live long and relatively normal lives. I suspect he wanted to be the Jonas Salk of the AIDS crisis and later the Jonas Salk of the COVID-19 saga. He has a long history as a successful bureaucratic infighter, and I believe he was the highest paid federal official.
