This settlement benefitted the people in the Biden DoJ and IRS who carried out these persecutions- they don't face having to defend lawsuits on a personal basis. If the settlement is upended, those lawsuits go forward and the Trump DoJ is under no obligation whatsoever to bury the evidence in the normal manner the federal government does and is under no obligation to fight to get those individual suits thrown out.

I am not sure it should matter that he was the sitting President, he still has rights that can be vindicated through the courts, plus it seems like a slam-dunk win - the IRS contractor who leaked the taxes was criminally convicted, seems abundantly clear that the IRS should be civilly liable for this. And as stated above, once a settlement has been reached, Trump can do whatever he wants with the settlement money, including giving it to J6'ers. This reminds me of DC Judge Emmet G. Sullivan (also a Black Leftwing Democrat). He refused to accept the DoJ dropping the case against General Flynn. Then appointed one of his buddies to in effect investigate and prosecute the case! He then dragged the whole thing out, causing Flynn to incur more legal fees, before Trump pardoned him.

Sullivan then had to mull that over, because District Judges are Kings who can thumb their noses at the POTUS pardon power. After all, what is a "Pardon"? Does it mean this, or does it mean that? Gosh, its so grey and murkey.

You have a choice here. You have a settlement. Or an open case. You don’t get to reopen the settlement, and leave the dismissal of the case in place. I expect that the judge thinks that he can do just that. But that deprives the plaintiffs of the benefit of their bargain.

Dave Begley--Luttig was on the list because Republicans regularly botch Supreme Court appointments (see Eisenhower (Brennan and Warren), Ford (Stevens), Reagan (O'Connor and Kennedy), Bush I (Souter), Bush 2 (Roberts), and Trump (Kavanaugh)). Conservatives have been extraordinarily lucky--from 1952-2024 they held the Presidency for 40 years (56% of the time), but they got to appoint 21 out of 30 Supreme Court justices during that period (70%). Nearly 1/3 of the R appointments have been disappointing, while the Ds are running at close to 100% liberals (I suspect that Whizzer White was too "conservative" for most Ds). On the other hand, many R nominees had to get by a D senate. I was surprised that Johnson failed to fill two seats before he left office (later filled by the Minnesota twins--Burger and Blackmun) and of course Ruth Bader Ginsburg's showboating cost Obama a chance to appoint a third liberal politician to the Court. One can only dream about how much better our country would be if the Rs had appointed Thomas/Alito candidates instead of the likes of Warren/Brennan/Stevens/O'Connor/Kennedy/Souter/Roberts/Kavanaugh.
