In fact, I can remember looking across the River in August and seeing Arkansas on the other side, and it looked just like that. Of course, it helps that its the other side is so dark you can mistake the farther shore for trees and not Madison.

This is why we have a Constitution, and are not a part of the United Kingdom anymore. I’m a non-smoker, and I’m glad that there are laws in Florida that limit the places where people can smoke in public. That said, I don’t believe that it’s the government’s business — ANY government — to ban tobacco and vapes for adults in the future. That way lies tyranny. What else will they choose to ban for people’s “own good”?

It will only apply to young people who are under 18 right now; in other words, people who can’t vote right now. This is different than a ban on things like heroin that affects everyone; it will only affect some people and not others, with an arbitrary age cutoff. In the U.S., such a law would be blatantly unconstitutional. And while I think that tobacco is an awful thing, I think government tyranny is worse.
I’ll just add that they are setting a bad precedent, if laws apply to some but not others, based on year of birth. When those kids come to power in twenty or thirty years, what kind of similar laws might they write that only apply to oldsters but not them? As the old saying goes, “Be nice to your kids; they’ll pick your nursing home.”

I Googled her and she is not a gigantic woman. I don't think she could 'restrain' the average man, or even the average woman. How is she supposed to have done this restraining?

Maybe she has a good impossibility defense. I'll volunteer to take part in a reenactment!

More seriously, is this a case of de-minimis getting blown out of proportion? I suppose she could smush someone against the wall through surprise, and then the victim wouldn't want to push her away because then they'd be the bully. But that means the victim wasn't actually restrained.

On the beach enjoying the water in the Gulf of America today, walking along breathing in the fresh salt air. And suddenly- the stench of cigarette smoke. I've gotten so used to smoke free air out in public that encountering it was jarring. Completely different from when I was a kid and surrounded by smokers anywhere I went.

There will always be users among us- of all kinds of things. Today's world is a big improvement over that of 60 years ago, at least as far as tobacco use goes. The ongoing effort- by liberals and libertarians- to downplay the effects of marijuana are disappointing. A little late in life to come to the realization, but an old HS buddy of my youngest child just admitted to him- "I should have listened to you, weed is really addictive."

Are you sure? The age limit would just get rational-basis scrutiny. The G would say the rational basis is it wants to ban tobacco - which it already has the power to do - but to do it in a way that's fair to people who currently use it.

It's kinda-sorta like the way drinking ages were raised to 21 one year at a time so that legal 18-yo drinkers didn't become illegal. But in reverse. CC, JSM

A quick read indicates your instincts were basically correct. In two of the incidents she trapped the other person against a wall, a third was a similar situation in a car, and the fourth was a case of grabbing at someone on a dance floor. "Restraining" was probably used because they didn't want to write that she was assaulting them, which is more accurate.

I think it would not pass muster in the US because it’s not an age limit like 21 for alcohol. It’s an outright prohibition—but only for some people. In that, it violates equality before the law.

We change laws all the time. People who were born under one set of laws reach the age of criminal responsibility under another set of laws. Some of the gun laws, like the Chicago handgun ban. had grandfather clauses. So someone who owned a pistol in 1975 (I think) could keep owning it for 50 or 60 years, while someone born in 1976 could never own a pistol. Such people were well into adulthood before the ban was overturned in McDonald (2010).

Now the pistol ban was eventually overturned, but the unfairness of grandfathering was not one of the reasons.

I guess I'm saying that "this law affects only people born after X year" and "this law affects only people who aren't already doing the thing it prohibits" eventually have the same result - kind of a rule against perpetuities sort of thing.

addendum: under both rules, you eventually reach an equilibrium where no one left alive is allowed to do the thing, after a period where some are and some aren't. (And I suppose with smoking, the people grandfathered in are not long for the "left alive" category.) I don't see how courts would concern themselves too much with the relative length of that "some can/some can't" period. CC, JSM

My friend has a nesting pair of Great-tailed Grackles in her yard. A couple of years ago, she found a dead baby grackle floating in her pool, fished it out, and buried it. Yesterday, while standing by the pool, a grackle flew right up to her, squawking loudly. It then flew to the nest, picked up a dead baby bird, and deliberately dropped it into the pool - continuing to squawk at my friend until she removed it and buried it again.
According to Grok, “grackles originally nested along rivers and streams. To keep their colony hidden from predators, parents would carry dead chicks away from the nest and drop them into the water, where currents would carry them off. In modern suburban settings swimming pools serve as the nearest substitute for a river.”
So this grackle remembered my friend as the “clean-up crew” from 2 years back.

A fort Bragg E-8 has been indicted in SDNY for making $300K on a poly market bet about the Maduro snatch.

I suppose it's good to crack down on this sort of thing, but it bugs me that he's being done in the civilian system, hundreds of miles from Bragg, for something clearly tied to his military conduct. Any number of UCMJ articles apply. He could easily be court martialled right at Bragg. Is the Admin afraid a panel would acquit?

This sets a bad precedent for lawfare against troops. Reminds me of the marines prosecuted in the civilian system for alleged war crimes after all their service obligations were over. But the G doesn't even have that excuse with this guy. CC, JSM

1. Encountering cigarette smoke in the wild doesn't seem to bother me much. Perhaps it is due to my mother smoking for 40 years (until she gave it up at age 54 - yes, she started at 14 in 1946; it still eventually killed her, but not before throat cancer took away her voicebox). While I sniff in disgust at discarded butts - are smokers the worst slobs evah - pot smoke in public seems to annoy me more.
2. When a liberal assaults someone, the hated media says it is a method of restraint. If it comes out in a sworn deposition that she finger-banged a victim, they will probably write, "She was simply pointing out to the accusers how they misinterpreted her actions."
