The reason for that is that the process is the punishment. It’s actually unethical for a prosecutor to file charges if he doesn’t reasonably think that he can obtain a conviction. And note that the standard in NY, as well as 48 other states, is that the prosecution must disprove Self Defense beyond a reasonable doubt. So 50/50 chance of beating Self Defense doesn’t cut it. Realistically, because the prosecutor has this legal burden, I would think that prosecuting a Self Defense case, where the prosecutor has less than maybe 75% chance at conviction would be unethical.
Still, prosecutors routinely violate this, prosecuting Self Defense cases all the time, knowing that they are unlikely to overcome that required level of proof. That is why FL enacted the statute that the left hates so much there. Throughout the prosecution of George Zimmerman, we were constantly barraged with criticism about the Stand Your Ground (SYD) statute. It was never an issue, since SYD is an abrogation of the common law Retreat Doctrine, and has been enacted or judicially enacted in almost every state. More to the point, Retreat Doctrine was never an issue in that case, because Martin never gave Zimmerman an opportunity to Retreat. Martin slugged him, knocked him to the ground, then sat on him, pummeling him MMA style, beating his head into the concrete, and then trying to strangle him. The location of the bullet holes in Marin’s hoody and body showed that he was on top and leaning over his victim when he was shot.
But what was (intentionally) confusing, was that what the left was really upset about was another statute enacted at the same time as the SYD statute that provided that SD defendants were entitled to a SD hearing, where they only had to prove SD by a preponderance of the evidence, and if they did, the prosecution was liable for the cost of defense. The purpose of that statute was to prevent just what you seem to prefer, and Bragg did here - using the process itself (the prosecution of someone with an obvious SD defense) to harm the defendant. Other states have enacted similar types of remedies against unscrupulous prosecutors in these cases, for the same reasons.
Despite failure of prosecution to get a conviction on Penny, the real lesson still stands: our intervention during violent assault could result in our arrest and prosecution. These days, a "hero" can easily face criminal charges for physical assault of violent criminal. Fear of arrest, of criminal prosecution, will prevent most people from interceding. Short-term and long-term outcomes of fighting back will stop most people from helping the victim(s). Penny's arrest on serious charges, his criminal trial, his significant legal costs, the progressive-liberal MSM negative press coverage and public misrepresentation of facts, the character assignation and long-term notoriety, the overall stress, these are all factors that will keep people from resisting their attackers, from intervening on behalf of other people, from even pressing charges against their assailants.
Freder, the police interviewed witnesses, looked at cell phone video, and interrogated Penny. They decided there was ample prima facie evidence of justified self defense, and declined to bring charges.
Bragg is the one who put Penny through this.

That is why FL enacted the statute that the left hates so much there. Throughout the prosecution of George Zimmerman, we were constantly barraged with criticism about the Stand Your Ground (SYD) statute. It was never an issue, since SYD is an abrogation of the common law Retreat Doctrine, and has been enacted or judicially enacted in almost every state. More to the point, Retreat Doctrine was never an issue in that case, because Martin never gave Zimmerman an opportunity to Retreat. Martin slugged him, knocked him to the ground, then sat on him, pummeling him MMA style, beating his head into the concrete, and then trying to strangle him. The location of the bullet holes in Marin’s hoody and body showed that he was on top and leaning over his victim when he was shot.
But what was (intentionally) confusing, was that what the left was really upset about was another statute enacted at the same time as the SYD statute that provided that SD defendants were entitled to a SD hearing, where they only had to prove SD by a preponderance of the evidence, and if they did, the prosecution was liable for the cost of defense. The purpose of that statute was to prevent just what you seem to prefer, and Bragg did here - using the process itself (the prosecution of someone with an obvious SD defense) to harm the defendant. Other states have enacted similar types of remedies against unscrupulous prosecutors in these cases, for the same reasons.

Despite failure of prosecution to get a conviction on Penny, the real lesson still stands: our intervention during violent assault could result in our arrest and prosecution. These days, a "hero" can easily face criminal charges for physical assault of violent criminal. Fear of arrest, of criminal prosecution, will prevent most people from interceding. Short-term and long-term outcomes of fighting back will stop most people from helping the victim(s). Penny's arrest on serious charges, his criminal trial, his significant legal costs, the progressive-liberal MSM negative press coverage and public misrepresentation of facts, the character assignation and long-term notoriety, the overall stress, these are all factors that will keep people from resisting their attackers, from intervening on behalf of other people, from even pressing charges against their assailants.
Freder, the police interviewed witnesses, looked at cell phone video, and interrogated Penny. They decided there was ample prima facie evidence of justified self defense, and declined to bring charges.
Bragg is the one who put Penny through this.
NB: at about the same time, a black subway passenger stabbed to death a psychotic person of color, in an evident case of self defense.
Bragg declined to charge.
Neely was not killed by Penny. Neely was alilve when the cops got there and Penny released him.
