I'd suggest waiting until the investigation has some data before jumping to conclusions. The victim & perp may have prior history. There may be an unknown connection between them. One or both might be simple criminals engaged in their business. There could be a third party instigating the actions of the gunman, who acted as a mere pawn. Could have been attempted suicide by cop. Or maybe it was indeed selection of a random Jewish person for attack by a Muslim fanatic. Time will tell.

I am very much against Hate Crime Legislation. I think when we started passing hate crime legislation 25 or so years ago it was a huge mistake. It encourages tribalism along smaller group-identities and diminishes a larger more unifying American identity. It also shifts the focus away from the crime itself to the criminal's feelings or beliefs. Criminal justice ought focus on the bad act itself, because in a free society criminal laws punish bad actions not bad thoughts.
All that being said, if hate crime laws exist they must be applied equally. And if hate crime charges are not going to be brought the police need to give all the information they have and explain why it doesn't qualify as a hate crime. Because on it's face it definitely looks very possible it was a hate crime. Was the criminal shouting "Allahu Ackbar," was it "From the river to the sea?" Are higher ups in the Police department and the mayor's administration worried it will make the Pro-Palestinian contingent look bad because they appear to have shared beliefs or motivations? Well too bad. Once hate crime legislation makes motivation an element of the crime then the public deserves to know the motivation. Selective non-enforcement of hate crime legislation breeds distrust and societal division. Several years ago, also in Chicago, there was a white special needs teenager who was kidnapped by a group of four black youths. They recorded themselves mocking, humiliating, and physically assaulting the special needs kid. The Chicago police again refused to bring hate crime charges in that case. If hate crime laws are going to exist it cannot be special protections for me and not for thee.

Every "hate crime" law and legal penumbra ought to be abolished or repealed. They've done nothing to make us safer or happier. On the contrary, hate crime laws engender hatred. Hate crime legislation was designed by grievance mongers and social revolutionaries to inflame hatred between communities, ethnic groups, a political persuasions. When a so-called hate crime is charged many people who have no connection to the alleged victim or the accused other than some remote point of commonality such as skin color or party affiliation feel invited to consider themselves equalled harmed or equally in jeopardy. Hate crime is confined by definition to hatreds between communities, and thereby inevitably pits one community against another rather than just the accused against the state.
