Another scary day...


ADDED: It can be scary even when you recognize that he was joking. He's President and in the position of enforcing the law, and from that position punching down. He really should not be joking about treason. And I get that he's punching back, and that's his style. But people aren't just idiots if they feel afraid of a President who isn't continually assuring us that he's aware of his profound responsibilities.

Good for the rest of us that you don't get to decide. Even better, the power of government to do so is decreasing every year. Humans are explorers and colonizers. Our long term survival depends upon creating extraterrestrial human colonies.

Bullshit. Adapting to new environments is what we do best. It is one of the reasons we are the dominant species on the planet. If the environment is too extreme, we change the environment. I live in what used to be a desert. Today it is a green oasis that hosts millions of people.

You ain't seen nothing yet...wait tell Musk builds the BFR transport system. Bezos's rocket looks to have eventual use too. I doubt Branson will ever make a go of it...he started first but both Musk and Bezos sped by him. Imagine a Sierra Nevada Dreamchaser mounted on a SpaceX reusable booster. What will be a little interesting is whether or not the aerospace dinosaurs are able to adapt or not.

Yes, we are too fragile - but I think that we are finally into space for the long haul. It is a classic example of the government being incompetent at most everything it tries. NASA went from putting a man on the moon to renting space with the Russians to get our people to the ISS. Where Muslim outreach had become more important than manned space flight, for the agency whose name is synonymous with the latter. The future is in private hands now, thanks, to some extent, to the X Prize that changed the emphasis, maybe forever.

I have read probably way too much SciFi than is helpful, over more than a half century now. Something I read a couple decades ago stuck in my head. There is far more cheap energy and resources in space than we will probably ever be able to utilize (not infinite - see Niven & Pornelle's "Ring World"). What is required is a certain level of infrastructure to be self-sustaining. The author hypothesized that we had a certain amount of excess hydrocarbons usable as rocket fuel, and once that was gone, we would never make it. And, with NASA mismanaging space exploration, and a quickly diminishing quantity of fossil fuels, I was figuring space exploration and exploitation to be a lost cause. But big money is now flowing into space exploration, while fracking has greatly increased the quantity of fuel available. I may not see us get to the self-sustaining level, but I think that our grandchildren may well might.

Energy in space can be nearly free - grossly abundant solar power merely requires essentially manufacturing solar panels utilizing the abundant energy and materials found in space, or from the moon - which is why it may be an attractive intermediate stop. Ultimately, asteroids can be nudged from their orbits well out from ours into intersecting ours, years, or decades later. Everything we need is out there, except, of course, gravity. Water, metals, etc. And with near free energy and metals, much manufacture can be done in space very cheaply. And, ultimately we could get to a point where both much of our manufacture and energy production is done in space, leaving most of us living on a Monday ch cleaner earth.

I think that the billions of dollars flowing into the private exploration of space right now indicates, to me, that a number of our tech billionaires, etc, have read the same stuff that I have, and realize that the amount of money that can be made in space far exceeds what can be made on the planet. And that it is now a good speculative investment. And, hence, my optimism.

Let's say that Candidate Trump did what he is accused of doing, working with Putin to influence the election. There doesn't seem to be any evidence so far that he did, but let's play pretend.

Would he be guilty of "treason"?

As several people have pointed out, it is a specific legal term with a specific meaning. It is defined in the Constitution:

Section. 3.
Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.


And in the CFR:


18 U.S. Code § 2381 - Treason

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.


So, pretending that Trump did collude with Russia in some form, would it be "treason"? The argument that colluding like this could be giving aid and comfort seems pretty weak, though perhaps not non-existent.

But they have to give aid and comfort to an "enemy". Does Russia fit that criteria? We are not at war with them. We may not be real friendly but I don't think they are "enemies" in the legal sense of the word. If Trump had colluded with, say, Italy, would that be treason? Could we call Italy an "enemy"?

Perhaps an attorney or, better, a Constitutional law professor might explicate the meaning of "treason" for us.
