"Could Trump Be Impeached Shortly After He Takes Office?/It's highly improbable, but law scholars and political junkies are speculating about it."

Oh, that's just something from last April, in Politico. It popped up first when I Googled "impeaching before elected" after reading the breaking news: "F.B.I. Reviewing New Emails in Hillary Clinton Case":
The F.B.I. said Friday that it had uncovered new emails related to the closed investigation into whether Hillary Clinton or her aides had mishandled classified information, potentially reigniting an issue that has weighed on the presidential campaign and offering a lifeline to Donald J. Trump less than two weeks before the election.

In a letter to Congress, the F.B.I. director, James B. Comey, said that emails had surfaced in an unrelated case, and that they “appear to be pertinent to the investigation.”

Mr. Comey said the F.B.I. was taking steps to “determine whether they contain classified information, as well as to assess their importance to our investigation.” He said he did not know how long it would take to review the emails, or whether the new information was significant.

This is one of these Friday afternoons.

Technically, Congress can impeach and remove a President for pretty much any reason. "High crimes and misdemeanors" can mean pretty much anything and there is no way to appeal. The only bar against it is public opinion and tradition. Frankly, if the Supreme Court actually tried to intervene, which Nixon v. United States ruled they cannot, there is the strong risk that Congress will simply impeach and remove the justices and then impeach and remove the President again, if necessary. Anything that would cause Congress to be that bipartisan and take that sort of political risk would ruin the Supreme Court completely.

So, sure, why not. One of the things that I prefer about Trump over Clinton is that Trump is disliked by both parties and it would be a lot easier to get rid of him if he got out of hand. Trump jokes about the concept that he could murder someone and still be supported. Politically, I think that assessment is more accurate about Clinton.

Impeachment is a combination of a legal and political remedy. If we elect Hilary Clinton President knowing of her conduct, a political decision has already been made by the voters. This is not an absolute bar to impeachment. The Congress could make another political-legal decision to impeach her and see if they get a conviction. But while they could do this, it would mean overturning a political decision by the voters to elect her despite her past actions.

If something new comes up, the elected politicians could have at it. But in my opinion they should act only if there is a new violation in a new category. Impeachment should not be a rehash of election results, however distasteful they may be.

(I plan to vote for Trump, by the way.)

The House might easily impeach by majority vote. But, since 2/3rds of the Senate must vote to convict, impeachment would be largely an empty gesture. The left (in the form of Democratic Party senators) would be very unlikely disposed to convict one of their own.

So it's just (even more) political dross.

Getting elected doesn't confer immunity from criminal prosecution. As for impeachment, obstruction of justice, misprision of felony and the rest of the conspiracy of attempted silence to prevent timely disclosure to the voters also doesn't legitimize a fraudulently won election by way of deception so the least harsh punishment for Clinton an impeachment and removal would be perfectly within the bounds of causation for removal. Or would you prefer that after she is elected that a Special Prosecutor indict her and convict her?

I'm feeling a little queasy about this.

Whatever is about to drop must be bad. Really bad.

Comey already faced a lot of really hard-to-deny intent and declared no sane prosecutor would indict because there was no clear intent.

I believe Comey refused to recommend indictment because he was convinced (and probably took some convincing) that by the time the Clintons were done defending themselves they would destroy the Bureau's good name: just taking sides in an election.

So what would persuade him to change his mind? It can't be more classified e-mails. He already laid that out: Eight TS threads including SAP. It can't be intent. I'm guessing it's either undeniable evidence of actual damage done, as opposed to "potentially grave damage," or someone saying "We will release this hugely, not-just-potentially, damaging information unless you proceed."

I'd like to think it's underlings saying, Let us do our job or a hundred of us resign and hold a press conference. Good luck papering that over. Precisely because I'd like to believe that, I'm skeptical.

What we are looking at here is not an election, but a war between ideologies.
Neither Party is going to allow its candidate to be convicted in an impeachment proceeding regardless of charges and evidence, unless the impeaching Party has 67 Senators.

And then if Trump wins and keeps the Senate, the FBI can make a separate peace with the Trump guys by really investigating Killery's High Crimes.

If Hillary was only as honorable and intelligent and competent as Nixon one might hold the nose so to speak. She doesn't even rate that. She is way worse. And Obama is up to his neck in it as well. That's probably why Comey gave Clinton a walk. Indeed the spectacle of a former president (Bill) and his wife the secretary of state running running a multi-hundred million dollar scam ( part of it with government funds) with the knowledge and blessing of the sitting president (Obama) and the AG's (Holder and Lynch) along with a number of high ranking officials makes Nixon's antics look like a shoplifted candy bar to a heist at Fort Knox. If the bit about seizing Huma Abedin's electronic devices in the Weiner investigation is true, this could be a killing blow to Clinton, even if she is elected in 11 days. It really is hard to explain why Comey would write such a letter to Congress this close to the election if this were nothing but a trivial matter. It is quite possible his own agents have forced his hand here.

I have long been of the opinion that Clinton, her aides and lawyers were involved in making sure all electronic records of her server's e-mails were deleted and scrubbed so that the only record of her conduct as SoS would be the printed versions they were content to have seen- otherwise, why provide only the printed copies? There really is no rational reason to proceed in that manner unless it really is nefarious. It is quite likely her aides were directly questioned on this matter, and I cannot imagine any of them said anything other than there was no such attempt. Can one confidently believe Abedin's electronic devices don't retain evidence of this activity?

My guess is that this goes nowhere. Comey hasn't "reopened" the case because cases aren't ever really "closed." The FBI will examine the three emails, classify them, and add them to the evidence of Clinton being "extremely careless."

If these emails turn out to be duplicates of ones already handed over to the FBI, then it is a big nothing-burger.

If they are ones that weren't previously turned over, but should have been because they were work related and from Clinton's server, then Clinton should face consequences for deleting them rather than turning them over.

More interestingly, they could be discussions between Clinton and Huma about how to handle the FOIA request, or the email scandal, or some such, and outline some form of cover-up/obstruction.

Taking a long view I don't think the emails will have much significance to the election. Trump will get a bump but he has one long road to win. We'll see.

I do wonder whether FBI rank and file might be driving this. The typical Washington bureaucrat is left-wing and supports the Democrats, but FBI at the agent level are often ex-military or ex-police and thus likely to lean right. Inside the beltway types might shrug it off as "she may be scum, but she's our scum", but the FBI at the working level may be pushing to bring this corrupt sleaze bag down.

Recruit a vixen / honey trap to start a lengthy exchange with AW. I'm not sure about this. If there is any new evidence, of any potential relevance at all, he is under some pressure to announce this, having essentially cleared her of legal wrong-doing previously. He clearly finish this business early, so that the FBI could not be accused of either influencing the election or of delaying the investigation to help Hillary. That effort has come back to bite him in the ass. He should have said and done nothing until after the election.

This may be true. But it won't help. Any decent intelligent person has already passed judgement on Hillary and her supporters.

The investigation is reopening because the rank and file FBI forced it. If they hadn't reopened there would have been mass resignations and a big press conference.

The only way Senate Dems would vote to remove Pres. Hillary is if politically that action saves their seats in the next two elections or somehow make the GOP a lock to win the Presidency in 2020. If the corruption and documented events that come out are so obvious and devastating that being seen as supporting it is electoral suicide, they will vote to remove. But that is a high bar to meet and very unlikely, but not impossible.

The re-opening of the case is magnified politically because Hillary and her surrogates put so much emphasis on the fact that the case was closed. That's been their consistent line, that the FBI investigated and found nothing wrong. That defense has turned into a huge liability - people leaning toward Hillary who heard that and bought it will be forced to seriously re-examine their support.

The fact that this has blown up on the various mainstream media outlets, bastions of Hillary's court stenographer propagandists, further demonstrates the magnitude of this decisions by the Bureau. And it's tied into the Weiner child sexting investigation, which brings the Clinton camp's sexual misconduct back into focus after they successfully shifted all the sex-related attention to Trump's comments and alleged misconduct. Just the association with the child sex stuff, however attenuated, will hurt her.

The timing could not be worse for Hillary. There's just enough time for this to continue building momentum until the election. Unless the contents of the emails are released before the election and they exonerate Clinton or are so de minimis as to be easily explained away, this is going to cause severe problems for the Clinton campaign. Despite the overwhelming headwinds, Trump might actually win this. And if Clinton should eke out a win, she's going to be crippled from the get-go and may well be a historically ineffective president.

This is a really big deal.

Previously HRC apologists (including Comey) could claim with a reasonably straight face that, yes, she shouldn't have used her secret server, but it wasn't strictly against the rules (because the guys who wrote the rules never thought anyone would be that stupid, but whatever . . . ) but everyone who had access to the server (HRC, Mills, Huma, Raines and her State Dept techs) all had the appropriate clearances, so bullet dodged and no harm no foul. Now go forth an sin no more.

If the classified info is now found on Weiner's dirty s@xt phone, that changes things.

We have every right to be pissed, and to welcome a thorough scouring of the DNC top-to-bottom, until it is finally replaced by honest and decent people. Either that, or we'll continue building the third parties, which is not the worst outcome. We will always remember how many people on the right were willing to see the bigger picture and sympathize with us in just wanting an honest government that put the American worker first, instead of going down this endless and bottomless road of a go-nowhere shell game that even sold out basic American security and national interests to the highest bidder. Whatever disagreements we had with the right, are small potatoes. The Clinton-run DNC is the greatest threat to democracy and our Republic, and we are happy that our friends on the right realized this and were happy to put aside differences and lend a supportive voice, where warranted, to the fact that the true FDR-legacy progressives had so much more in common with them in just wanting to put America, starting with the least among us, first. Anthony weiner was sexting for quite some time. If you look at the time lines, there was almost a year between when the sexting took place and when it came out. The theory was that someone knew about it and was holding it over Weiner's head.

"Get us the data on Huma's Blackberry or the papers get the evidence of your texting."

Not hard to do, all weiner would need to do would be slip a USB stick or sim card into the Blackberry. It would plant a trojan that would send all the data to whoever had the goods on Weiner. Weiner might even know the password so they don't have to work around that.

I don't know if that would rise to the technical level of "treason", in the legal sense but it certainly would not be good.

Once in Huma's Blackberry, the malefactor would have releatively easy access to Huma's email and other stuff. They could send emails from Huma with Trojans to Crooked Hilary and others in her network.

All weiner would need would be a minute with the phone. Say when Huma went to take a leak.

The way I read it Huma backed up her e-mails from Hillary on Anthony Wiener's computer. So now we have all of Hillary's e-mails to Huma and can see if she deleted important ones in what she gave to Congress. (I wonder if she did, said Rebecca of Sunnybrook Farm.) And - Huma put classified e-mails on a non-secure computer - Wiener's. She is not running for President and can be convicted of that like any other citizen. And Wiener was vulnerable to blackmail.

So Comey could not have waited till after the election to reveal this. But also think about this. The only way this could be cleared up before the election is if Hillary tells the truth now. If she doesn't and wins then it will all come out after the election as lies that enabled her to President. If she tells the truth, she will lose because of what the truth is, see Wikileaks.

Anyhow, imagine being a Democrat and thinking the whole thing rests on Hillary telling the truth in order to prove her integrity.

PS I heard that Wiener's dildo was in that DDOS attack along with many others and that's why the FBI thought of looking at his computer at all.

My best guess is that Comeh decided he had to do a quick CYA when Judicial Watch's subpoena/FOIA came in demanding all undisclosed e-mails on Killery which meant the Server the FBI was holding from a back up storage service that came from Platt River IT Services.

The FBI had ALL her emails and phone calls all along. They were hiding it.

But the moment Trump went into a sure winner in the Private Polls, the FBI knew they would be exposed when Trump came into Office...unless they could find an excuse to reveal what they had ASAP.

They used the sexual Carlos Danger investigation as an attractive excuse to pretend they accidentally just found it all on a Huma's laptop.

And here we are. The wrestler Trump instantly put the FBI into a pin hold by congratulating them for finally being honest again. That's a hard to live up to branding for them.

I noticed that Trump had Dan Gable at his Iowa event tonight. He acknowledged Dan as the greatest wrestler in history and a man who knows how to win. Besides his baseball, DaTrump was a wrestler in Military School. Wrestling especially teaches men mental toughness and winning...since you are going to suffer one way or the other, why not win it.

Immunity, kids. The word of the day is immunity.
To how many of the important people in this investigation did the FBI already grant immunity? How many of the gov. workers, the tech people, have taken the 5th in response to Congressional questioning? Are any of those people now suddenly subject to pressure from the FBI? Why?
The way it works is that the Feds develop some hunches about a case, then bring some low level people in and question them. Lying to a Fed is a big bad crime, so the choice then is to incriminate yourself or refuse to answer. If you refuse then ty know you're vulnerable-- interview other low level people and target you. Once they have something on you they squeeze--they offer a deal for cooperation vs some federal charges (with long minimum no-parole sentences, super-expensive court/lawyer costs, etc). You roll on your superior, and they work their way up.
This investigation was tanked from the beginning when the FBI tossed immunity out like candy. They immunized all the low level people and barely bothered to interview the high level people...they did not have any leverage at that point anyway. Read Andy McCarthy, it is obvious.
Are any of those immunity deals in jeopardy? If not this is all theater.

Hillary's chief aide put classified material on an insecure PC belonging to her totally compromised husband and she had classified e-mail on this computer till yesterday. Hillary said that kind of behavior was a mistake but Huma didn't change. So it isn't the FBI on trial; it is Hillary and Huma and whether Hillary defends Huma leaving the e-mails out in the open. And what the e-mails say - do they back up Wikileaks?

Only Hillary can clear herself by explaining now what will be found. If she doesn't try to clear herself, I'm not sure she will be elected because just snarling that the FBI has joined Russia in the plot against her makes Trump look moderate.

The FBI, the CIA and the Justice Department are in effect owned by the President and operate outside the law at his command. Clinton started that politicizing them at the top. Obama continued doing it and added the top military Officers.

The big bomb is DaTrump. They know that he is going to FIRE them all.

Which brings up the last time Nazis lost and had to run for cover. They stashed stolen gold in Switzerland and followed the Jesuit Run Rat Line to Argentina. The ones who had an industrial skill and dark science to sell made a deal with their long time American contact person, Preston Bush, supposedly to help fight communists by "joining the CIA." By the end of Eisenhower's term they had co-opted the CIA, and that in turn created the Bush Family's power.

It was John W. Campbell, Jr. (called the “father of modern science fiction”; powerful writer in his own right [“The Thing”], but also editor for many years of Astounding/Analog magazine, whence he cultivated a generation of superb science fiction and fantasy writers: Heinlein, Clarke, Asimov, et al.) who pointed this out, in one of his characteristic thought-provoking editorials at Analog: that it wasn't POWER per se that was corrupting, or (if unlimited) was absolutely corrupting — but rather it is IMMUNITY from negative consequences for the use/abuse of one's power, that is corrupting — and finally (if one is totally immune from ANY consequences), absolutely corrupting.

For instance (this is me now), Alexis de Tocqueville in his famous work “Democracy in America” from the 1830's noted that American localities would often appoint magistrates granting them very considerable power — but then made them quite frequently stand for reelection — moments they could be tossed out of office on their ear if seen by the public to be abusing that power. As a result, Tocqueville observed that in democratic America (at least at that time) politicians frequently did not abuse their power all that often — despite wielding, oftentimes, quite a lot of it — because they were not IMMUNE to the consequences if they became corrupt, and knew it.

Another exemplar may be seen with the proverbial petty bureaucrat — at the Department of Motor Vehicles, say — who in actuality may wield little real power, but because such bureaucrats ARE (or can be) largely immune from suffering any consequences as a result of throwing their power and weight around, the public gets trashed.

Unfortunately, as we see these days with Clinton: all checks (beyond just not electing her) are now inoperative and defunct. She isn't even president yet, but conducts herself (with regard to, e.g., security — but it's also true for many other aspects of her life) as if she were queen; meanwhile the media and the Justice Dept. do backward handsprings to make sure she isn't even slightly discomfited by consequences.

Hillary! deserves a trial, but this election is the probably only trial she will ever get. No wonder she acts totally corrupt!

Camille Paglia (Jill Stein voter) said in an interview just before this broke that a Trump win would blow up the Democratic Party, the GOP and the media. Or as other non-conservative Michael Moore said, electing Trump would be the biggest 'fuck you' in US history.

I was stunned by Clinton's short press conference, especially her answer to the question concerning what Huma Abedin told her. Almost every single word out of Clinton's mouth in that press conference was not only a lie, but obvious ones.

As for the FBI declaring what they found- Abedin should still have access to those e-mail accounts, and if she doesn't, she surely knows what is contained in them. If Abedin doesn't give a full and unfettered press conference in the next 3 days, then you know it is really, really bad for Clinton. If all of this were truly of no consequence, Abedin herself could clear it up in an afternoon.

Hmm. What State Department emails would Huma forward to her own computer? Probably ones that would insure her against a HRC double cross. Say, the ones that detail:

- All the pay-for-play corruption at the Clinton foundation?
- Bengazi lies/gunrunning?
- Premeditated classified information handling violations?
- What else?

The idea that she forwarded those to her own computer to make it easier for her to print them out only makes sense if they were too radioactive to print at work and risk getting caught doing so. I wouldn't be a bit surprised if the FBI didn't get everything they were looking for handed to them in a single file on a computer Huma was stupid enough to share with her unbalanced husband. Karma, can be a bitch!

I never listen to talk radio so I’ll take your word for it. I like music when I’m driving. But I’m interested to hear the details of what they had to say. For instance – what they thought about polling accuracy. Any links to some audio of talk radio predicting a favorable trend for Trump in the last days of the campaign?

So what happened here? Did the FBI Director finally find shame? Did Trump cut a deal with Pres Obama involving the hypo-vehiculation of Hillary?

My current favorite theory:

Comey and Andrew McCabe, who directed the Hillary email investigation, headed up what was probably a cover-up. Comey had political motives; he’s eGOP and I’ll bet he’s an unannounced NeverTrumper. McCabe’s wife, who ran unsuccessfully for the Senate, got a large campaign contribution out of it. McCabe got a promotion to an important position in the FBI.

I doubt if it could be proven that any laws were broken by Comey, McCabe or McCabe’s wife. Evidence against Hillary possibly destroyed by the McCabe investigative group? Impossible to prove if no one squeals. So I think Comey and McCabe need not worry about legal repercussions. It just smells to high heaven. It’s only embarrassing, not fatal.

But the FBI Anthony Weiner sexting investigation is apparently being conducted by a completely different group within the FBI … who found some bad shit on the confiscated Weiner/Abedin shared family laptop. The word has probably spread inside the FBI and evidently to some newshounds about the discovery of the bad shit on the laptop and Comey realizes that if he tries to smother this he could be caught up in something he cannot control.

If Hillary were elected(she won’t be) or even if she weren’t and was found later to be guilty of crimes because Comey couldn’t quash the Weiner sexting investigation, Comey might be this scandal’s next victim. Thus, Comey’s letter to Congress, classic CYA behavior. I doubt if we’ll learn more about this than what is already public knowledge until after the election.

If I were an enterprising prosecutor I would look into McCabe’s wife’s campaign finances. They funneled the Hillary money through it. Maybe there’s other pay-offs to be found.

As has been asked...how did Comey not seize ALL of Huma's computers? Why would this stuff be a huge shock if they did a competent investigation?

Also, cute that Progressives now feel the election is being rigged against them.

The way I see it, there are only two people/organizations with any power who are actually keeping America together right now: James Comey and Julian Assange. And Assange lives as a hostage to the NSA, the sympathy of his British captors notwithstanding, with his only outside line to the world cut.

That's the sad thing. Assange should win the Pulitzer and he, instead, under house arrest. I have no faith in Comey doing the right thing.
