Said the 4th Circuit Court of Appeals, finding that the Gloucester County School Board's policy violates Title IX.
[Gavin] Grimm was born female but identifies as male. He was allowed to use the boys' restrooms at the school for several weeks in 2014. But after some parents complained, the school board adopted a policy requiring students to use either the restroom that corresponds with their biological gender or a private, single-stall restroom.

I was at a relative's house last weekend and a reality show was on in the background about life in jail. There was a men's and a women's totally separate.
What about that? If restrooms must be gender neutral, what about other facilities like jails? Is there are a reason why these changes won't apply there?

No matter how black your robes are or how smart you think you are you cannot come up with a reason why there is going to be a 'person' with a dick in the same restroom as my soon to be 3 year old daughter unless it is me with her in the men's bathroom. Soon she will be too old for that and she will be going in the woman's bathroom while I wait outside. It will be clobberin' time first if you let men hang out in that bathroom.

If they are lucky the people on this court will get to watch the Trump presidency and this garbage will start getting rolled back peacefully. Otherwise it will get rolled back the other way.

Every stadium event I have attended lately has had women use the men's room, and nary a tear was shed in distress. They come in pairs and groups or with boyfriends/husbands because their lines are too long.

I noticed something.

Most places don't have laws about the "Gentleman's room" vs. "Ladie's Room" users.

Because society developed a very strong social incentive that worked.

There must have been a reason for that choice.

Some sort of society-wide decision that large public facilities of this type should be separated.

There's a sense that even though most men and women could behave themselves, there is always that one stranger in one hundred who could use a mixed-sex lavatory for voyeurism. Or sexual harassment. Or assault.

And to make it easy to stop that--and to install a strong cultural barrier against it--we set up rules of social opprobrium and shame to convince people to use one room, and not the other.

(I also notice that public restrooms are from the age of urbanization and indoor plumbing. Yet the people who made those decisions also made decisions about bathing, privacy, and social boundaries in small families, towns, and cities, during the era just before indoor plumbing.)

How much do people want to weaken that strong social rule about propriety, privacy, and avoiding even the remotest possibility of strong people preying on weak people?

I understand the desire for change. American culture has been full of change. And we spent the last tree-quarters of a century changing the social rules relating to sexual intimacy.

But change by itself is not always good.

And what happens when the culture tears apart old social rules, and discovers a generation later than the results are worse than the original problem?

These seems like terrible legal reasoning to me. The people interpreting aren't the people who wrote Title IX. They are activists using an existing regulation to create new rules and to branch into areas not even imagined by the writers of Title IX.

No matter how you feel about the merits, this is not a fight that was "picked" by social conservatives.

This is a fight that was conclusively started by the Obama Administration's Department of Education Office of Civil Rights social activists. Using Title IX to literally threaten individual schools and school districts with federal punishment if they don't conform to Obama social mores. Just like the supposed campus rape crisis.

But if we have to do something, let's just make the men's room an "anybody" room (it kind of already is), and continue to restrict the women's room to actual biological women or post-operative transsexuals. That way nobody will feel stigmatized for using the men's room, and women can have some damn privacy which was the whole point of segregated restrooms in the first place.

Wait. Why is deference due to a regulatory agency in "interpretation of its own regulations"?
The regulations define the scope of the agency, not the other way around. Otherwise you can simply write wishes on your magic piece of paper to give yourself whatever authority you want. In the IT industry this would be called a privilege escalation attack.

If an agency feels it needs more latitude then the agency is in the perfect position to lobby for legislation that gives them that latitude. Otherwise no dice.
