The problem with making rape a capital crime is that it encourages rapists to kill their victims. They have nothing to lose, and killing the witness makes it less likely that they will be caught.

But people who murder others, including in rape, don't seem to think about that consequence much.

It also skews the legal process and prejudices it to punish the women instead of the men.

That is why, for a *capital* crime, rape in Islamic countries (or some of them, to be sure) requires something like three witnesses. And it should, don't you think? Someone shouldn't be killed without absolute proof. So they aren't going to kill a man with less than three witnesses. So instead, seeing how she just confessed to being a slut, the woman is punished.

My uncle, who was a county deputy sheriff said the same was true of any law that seemed too harsh. If nothing else the cops would ignore it if they could.

And so we've got this lady who *probably* had no other real options. And if she is convicted of murder at least her children won't carry the stigmatism of having a mother who was a whore.

The dead guy who made the mistake of forcing her to continue an affair by blackmail (however "voluntary" the first encounter) learned an important lesson.

If he's shaming her into continuing because she's trying to protect her public honor and her children's reputation from what he's threatening to reveal to the world... getting her pregnant is a terminally bad idea.

This reminds me of an old law review article I read in Con Law. The author was making a comparison between torture and plea bargaining.

Because medieval law required two witnesses to convict a criminal OR a confession, and because there were never two witnesses, torture became a common way to extract a confession and resolve the case.

Our criminal justice system has so many safeguards that it's unworkable so plea bargaining has become the real system, not the jury trial.

Make a system unworkable and people work around it.

Somewhere between 1 and 3 humans will die because of this. Sex is expensive business if you don't do it right. It's hard to believe it can also be loving, life affirming or casual. Context is everything.

What's interesting is there really seems to be a crackdown on women "rapists". That is to say, women having sex with underage boys.

And I guess that's good, for equal justice under the law. And yet I feel way more sympathy for a woman having sex with an underage guy than a man having sex with an underage girl.

I'm like, "throw the book at him!"

And "let her go!"

Totally unfair.

There's a huge number of women having sex with underage boys, apparently. What is up with that?

Those are not good mug shots, by the way.

Although Megan Crafton is hot. And "the victim" was 17. I would totally let her go.

Amber Jenkins, also smoking hot. She got probation.

Carrie McCandless, way hot. She got 45 days in jail.

If I was a prosecutor, I would want an all-female jury in these cases. I'd want an all female jury, a female prosecutor, and a female judge.

Because they don't want to deal with equals. It would be pretty easy for an experienced older woman to control and pyschologically manipulate a horny 17 year old boy. It's harder to control a man, even a horny one. Any man worth their salt, that is.

Meh. I imagine myself sitting on the edge of the bed, listening to some pimply high schooler talk about trying out for the football team and how boring Mrs. Jones the English teacher is and wondering if Taco Bell is hiring...doesn't fill me with erotic longings.

It strikes me as odd that more Muslim women don't kill their rapists, since they will be jailed or honor-killed for being raped. Really, SHE has nothing to lose.

Did anyone else find the woman's alleged statement that she'd be willing to die so long as she got an abortion, er, damned strange? She could accomplish both things at a stroke, as it were, all by herself. I realize that Islam isn't keen on suicide (except in special cases, as when you can take a bunch of your enemies with you), but then it's not especially keen on abortion either.

The landlord (hotly dressed female) comes into the apartment telling the renter to leave. He refuses, and she starts acting hysterical yelling that he's trying to rape her and won't let her leave, while he clearly never touches her and the door is open. If he didn't have it on video, it would be his word against hers and her two companions. This is what we call an "illegitimate rape".

See, in 2008's Kennedy v. Louisiana, Justices Kennedy, Stevens, Souter, Ginsburg, and Breyer said it was unconstitutional for rape to be a capital crime.

For rape to be restored to its historical status as a capital crime, we're going to need more justices like Alito, Roberts, Scalia, and Thomas. And Obama isn't going to appoint them.

Firearms even up the physical balance of power between men and women. NOW should be a big ally of the NRA. Given the decades that NOW has has to figure this out I am mystified that it is not.
